from Pike county, was convicted in
the United Stiles oourt yesterday of
illicit dleUlUng. Judge. Speer deterred
sentence until today. '<
Thia case, by reason of the promt'
nence of the defendant, has been made
one Of the moat Interesting that has
come up in the United States oourt on
the revenue docket during the past ten
days' session of the court here. The
evidence against .him • has, all. alpnpr-
been strong, but the fight-made by his
attorney, M. G. 'Bayne, has been stub
born and, and District Attorney Gary
found it necessary to make gOf>d use'
of every, thread of "his evidence to se-
ceure his conviction. Thetact, however,
that, a prisoner Is referred to Judge-
tjneer's court by Commissioner Erwin
is sufficient to give him good reason to
tear the result, for It is seldom.that he,
and the district attorney are not sus
tained by the Jury, and In every in
stance where a defendant escapes pun
ishment it Is only by tho skin of his
teeth. m

The examination of witnesses was not

A verdict of not guilty was rendered
In the case of the government agalnat
Bryant, • Vaughan. Vattghani was
charged with working in an illicit dis
tillery, and after the verdict of the
Jury had been read Judge Speer de
livered some interesting remarks oh
what constitutes working In an illicit
dlstlllety, iwhch will be of material aid
to Juries In this court hereafter.
The* government’s evidence against
the prisoner, who is a negro, was'that
he had hauled some wood to the still
of Sam Fogg, and bad placed some of
the wood on the fire at the still. The
man confessed this, but his defense
was that In doing so it was not with
any intention of defrauding the gov
ernment by aiding or abetting in tho
operation of the unlawful machine;
that he was simply hired to bout the
Wpdd, and while around tho still where
%\>Bg was at work had Incidentally
placed'a few sticks of wood on the
lire.
The Jury from their verdict sustained
the defense, and Judge Speer gavespe-
claf emphasis to ’their position on tho
case. The court held that the mere
putting of a few sticks of wood on
the fire or even pouring water in the
tank, where there Is no evident inten
tion of aiding or aibettlng fraud, was
not evidence of guilt sufficient to con
vict, and cautioned the. Jury on this
point for their future use in the trial
of simitar oases. Col. N. E. Harris
represented Vaughan.

“I have not known Macon to bo
healthier than at present," said Dr.
Charles H. Hall yesterday when asked
about the health ot the city.
"Summer," continued! Dr. Hall,
"strange to say, is the healthiest time
of year with us,” continued tho learned
doctor, “and this summer la no excep
tion. There has been comparatively
little fever In Macon this summer, and
I have never known a summer in Ma
con when there was lees sickness of
all kinds in the city during my long
residence here.
"Macon Is the most fortunate city I
know of. With only the sewerage the
Lord gave us we have been as healthy
a peopie.as you will find in the world.
Our death rate is as small as you will
find anywhere and our mortality rate
Is as low. If not lower, than any city
of equal size.
"Yes," concluded, the doctor, "we are
Indeed a fortunate people, with good
iiea.th the year round, but especially
so during the hot months.”
Everybody in Macon and'nearly ev
erybody In Georgia knows Dr. Half

there Is no man Whose word would be
more fully accepted than hia. His
long residence and -practice In .this chy,
his high standing as a physician and
man and his knowledge on the subject
of which he was talking make his
statements of great value, os no better
authority could be found.

city are beautiful and commodious
parks, where all kinds of harmless

can be induced to come here once and
spend a few weeks her fame will soon

In Mqpon. They were taken In chargo
by the hospitable people and looked of
ter attentively.
On Thursday MaJ. Winters of the
Consolidated Street Railway Company,
who is always on the alert for such
opportunities to do tho hospitality act
to visitors to his city, took the young
Indies on a long ride around his entire
system In one ot those open cars that
will cure a case ot fever on the hottest
day In July. The rpajor himself had
charge of the little excurslbn, and all
the nice 'things said about him by the
pretty school girls from LaGrange over
came hla modesty when he heard about
them. yesterday after tho parly had
gone. ■
The viattors were ecstatic in their ex
pressions of seeing Macon as few people
who come here do. and for this trip
alone they carried homo with them
every sort of good feeling for the mi
Jor and hla fine car lines.
They were extended many social hon
ors during their stay. Judge John L.
Ilardoman tendered them an early
morning drive yesterday before they
left at 11 o’clock.

Judge Hardeman's Decision on the
Colored Mason Muddle. •
The lnjuctlon prayed for by certain
colored Masons, who claimed to have
been elected officers ot the grand lodge,
to enjoin J. D, Campbell and others
from taking charge of certain funds
In possession of the grand treasurer
and to prevent them from In any man
ner Interfering with the grand lodge
property, was hoard' in the superior
court yesterday.
The case occupied the attention ot
the court air day, and throughou t tho
hearing the count room was'well filled
with negroes, who were anxious to see
the outcome. Both sides were well rep
resented by leading attorneys of the
city and each made a hard fight. Late
yesterday afternoon Judge, Hardeman
dissolved the Injunction.
