Rev. .W. B. Jennings, pastor of the First Presbyterian church, has, through Ills attorneys. Messrs. Anderson. Anderson, petitioned for an injunction enjoining the Board of Education from making an appropriation for the main tenance of Fourth street school. . The petition has not yee been de cided by Judge Jenkins, to whom It was sent, owing to his absence from home, but it Is expected that he will render a decision on Monday or Tues day. The public Is familiar with the causes leading up to the petition, as the Telegraph told some time ago of a petition signed by a number of minis ters at the o>ty and others asking the Board of Education to refuse to make further appropriations for the Fourth street school and giving as their rea eons for such request that the school Was a denomenattonal school and was conducted solely In the Interest of the Catholic church. The Board of Educa tion submitted a report on this petition tnvd 'tails report, which was made some time afterward, was unsatisfactory to tie. paarjjners, the board taking The ground fact the school was nat a de- aomlmitlcnat school. The public thought this disposed of the Question, end it will no doubt be somewhat of a surprise to learn than Mr. Jennings «i.ts appealed to the law.
