Two Noted Cases Tried In Washington
County . Superior Court
Sandersvllle, Sept. 7.—(Speclnl.)—Tho
September term o< Washington supe
rior oourt convened last Monday morn
ing at 9 o'clock, Judge K .L. Gamble of
the middle circuit presiding.
There were two Important cases on
tho criminal docket. The .case of J. M.
Rogers, charged with murder, was
called Wednesday morning and the trial
oont-ned all during the day aud until
10 o'clock at night. The Jury remained
In the room all night aud throughout
yesterday morning. A verdict of guilty
was rendered, with .recommendation
that he be confined In tho penitentiary
for life.
Mr. Rogers Is chnrged with killing
Mr. Junius Lawrence, an old man who
resided lu the lower portion of tho
county, ou Sunday ulgbt. May 21, lSDII.
A crowd consisting of about half n
down men went to tho house of this old
man and called him out for the purjiose
of whipping him. 'Mr. Lawrence fought
them nnd during tho struggle ho
knocked the mask from tho face of ono
man, when he was shot. It was clearly
proven that this man whoso fnco wiib
uncovered Is J. <U. Rogers. At the time
of tho shooting n fusllado of shots was
llrod and ono William Downs was shot
In the arm, nnd after being arrested
nnd placed In Jail here died In prison.
Rogers Is also Indicted for killing
Down*.
Yesterday morning tho case of tho
state against W. ,T. Bush was called
and both side* announced ready for
trial. Aftor hearing thb evidence nrtd
arguments tho jury returned a verdict
of voluntary manslaughter.

NOTICE.—SALE OF THE MACON
AND NORTHERN RAILROAD.
Undvr and by virtue of a Anal de
cree rendered on the 30th day of July,
ISM, by the United States circuit court
for the western division of the southern
district of Georgia, in the cane of the
Mercantile Trust Company of New
York and okher complainants ngainst
the Macon and Northern Railroad Com
pany and other defendants, we will
sell before the United States court
house door in the city of Macon, Geor
gia, on the second day ot October, 1894,
between the legal hours of sale, all of
the following described property:
First. The railroad of the said de
fendant, the 'Maoon and Northern Rail
road Company, which extends from the
depot tn the city of Macon, Georgia,
to Its Junction with the Northeastern
railroad at Athene, Georgia, a distance
of about one hundred and seven miles,
together with all Its railways, Ways,
and right of way. side tracks, turnouts,
depot grounds, easements and other
lands and appurtenances belonging to
said railroad company, which nrp set
out In said decree.
Second. All structures, depots, sta
tion and section houses, engine houses,
car houses, machine shops find other
buildings, with tools now In use and
equipments now In hands of the receiver
Four passenger coaches, two combina
tion mall, baggage and express cars,
sixty box cars, twenty-two flat oars,
two caboose cars, three shanty cars,
three passenger engines, one switch
nnd two freight engines, together with
all other property, equipments and
franchises belonging to said defendant,
and which are fully set forth in decree
referred to. Also, all supplies and
richer property In the hands of the re
ceiver ot said company. Also fifteen
hundred shares of the capital stock of
the Georgia Midland Railroad Compa
ny If the par value of 6100 per share.
Third. In the sale of said property,
no bid for a sum less than one million
and severity thousand (61,070,000) dollars
will be received, nor from any bidder
who shall not price Into the hands of
the speotal commissioners at the time
of making the bid the sum of 630,000
in money or certified Check, and from
time to time thereafter euoh further
portions of the purchase price shall be
paid In cash as the court may direct
to meet expenses of the suit, etc. That
the bidder depositing said {SO,000. nnd
whose bid is not tho highest, shall have
such deposit returned to him without
deduction. In the even the bid accepted
by the commissioners is not confirmed
by the court, such bidder Shall have
such deposit returned to him without
deduction unless said property is resold
at the expense of euch bidder and be-
oause of fils fault.
Fourth. The balance of the purchase
price may be either paid in cash or In
the bonds and over-due coupons of sold
Macon and Northern Railroad Compa
ny which are secured by the mortgage
upon which the decree ot foreclosure
Is based. Such bonds and coupons be
ing received at such price nnd value ns
the purchaser would be entitled to re
ceive ss his prorata share In the distri
bution of said fund.
■Fifth. The sale to be made subject
to all claims pending against said com
pany or which are filed three months
thereafter, und oil debts against the
receiver, which claims or debts the
court may decree to have priority over
the mortgage foreclosed by said de
cree. the purchaser will be required to
assume payment of same. The sale to
be reported to the court for confirma
tion, nnd when confirmed the special
commissioners will make title to the
purchaser In accordance with said de
cree. For further details of said sale,
reference la made to eald decree.
