men nuimed Robert Clemens nnd James
Pollen fought a duel to the death with
knives -last night, in the -woods near

night by a farmer. Each was stabbed
twenty or thirty times and are beyond

NOTICE.-SALE OF THE MACON
AND NORTHERN RAILROAD.
Under and by virtue of a final de
cree rendered on the 39th day of July,
1894, by the United States circuit court
for the western division ot the southern
district of Georgia, in the oase of the
Mercantile Trust Company of New
York and ether complainants against
the Macon and Northern Railroad Com
pany and other defendants, swe will
sell before the United States court
house door In the city of Macon, Geor
gia, on the second day of October, 1894,
between (toe legal hours of sale, all of
the following described property:
First. The railroad of ttoe said de
fendant, the Macon and Northern Rail
road Company, which extends from the
depot in the city of Macon, Georgia,
to It* Junction with the Northeastern
railroad at Athens, Georgia, a distance
of about one hundred and seven miles,
together with all its railways, ways,
and right of way, side tracks, turnouts,
depot grounds, easements and other
lands nnd appurtenances belonging to
said railroad company, which are set
out in said decree.
Second. All structures, depots, eta-
tlon and section houses, engine houses,
car houses, machine shops and other
buildings, with tools now Ip use and
equipments now in hands of ttoe receiver
Four passenger coaches, two combina
tion null, baggage and express care,
sixty box cars, twenity-two flat oars,
two caboose cars, three shanty cars,
three passenger engines, one switch
and two freight engines, together with
all other property, equipments and
franchises belonging to said defendant,
and which are fully set-forth in decree
referred tb. Also, all supplies and
other property in the hands of the re
ceiver of said company. Also fifteen
hundred shares of the capital stock of
ttoe Georgia Midland Railroad Compa
ny If tho par value of 3W9 per shore.
Third. In the sale of said property,
no bid for d sum less than one million
nnd seven’ty thousand (31,070,000) dollars
will be received, nor from any bidder
who shall not place into the hands of
the speolal commissioners at the time
of making the bid the sum of »30,000
In money or certified check, and from
time to time thereafter «uoh further
portions of the purchase price shall be
paid In oath os the court may direct
to meet expenses of the suit, stc. Thnt
ths bidder depositing said 330,000, and
whose bid is not the highest, shall have
such deposit returned to him without
deduction. In ttoe even the bid accepted
by the commlsslonorsiis not confirmed
by the court, such bidder Shall have
such deposit returned to him without
deduction unless said property Is resold
at the expense of suob bidder and be-
oause of tols fault.
Fourth. The balance of the purchase
price may be either pild In cash or in
the bonds and over-due coupons of said
Macon and Northern Railroad Compa
ny which are secured by ttoe mortgttge
upon which the decree ot foreclosure
Is based. Such bonds and coupons be
ing received at such price nnd valuo os
the purchaser would be entitled to re
ceive as his prorata share In the distri
bution of said fund.
Fifth. The *Hle to be made subjeet
to all claims pending ngalnst said com
pany or which are filed three months
thereafter, and all debts against the
receiver, which claims or debts tbe
court may decree to have priority over
ttoe mortgage •foreclosed by said de
cree, the purchaser will be required to
assume payment of same. The sale to
be reported to the court for confirma
tion, and when confirmed the special
commissioners will make title to the
purchaser In accordance with said de
cree. For further details of said sale,
reference Is made to said decree.
