THE BANKING JUDGE.
It le Decided TMat a Supreme Court Jus
tice Stands Highest.
.Washington, Dee. : 3.—The supreme court
today announced Ur unanimous belief
that between an associate Justice of that
bench and the judge of the district court
of the United States the former Is the
ranking official. Chief Justice Fuller
stated the matter at the opening of the
court today. Several weeks ago ex-Attor-
ney General Garland, as counsel for La
fayette Hudson, moved the court for
leave to file a petition of writ of man-
damns directed to Judge Parker of the
United States court for the western dis
trict of Arkansas. Hudson had been con
victed In Judge Parker’s court of assault
with Intent to kill and sentenced to the
penitentiary for five years. Justice.White,
issued a writ of-error and supersedeas In'
the ease, the defendant to file a bond of
*5.000. Judge Parker refused to release
Hudson pending the decision of the writ
of error, whereupon Mr. Garland made
the motion referred to. Chief Justice Fuller
announced today that the motion had
bcc-n granted and the writ was ordered to
be Issued, being made returnable on the
first Monday in January next.
