The difficulty (hat led to the killing

street. Davis was very drunk and dis

suade him to keep qu'ct, but ho re
fused lo do so. Finally Mra. Nelms
told him ho must gat jout of the house
and, upon his refusal 'to do so, elio
pushed him out. By this time tho
guests art (he house had commenced to
depart, some of Idle ladies fearing a
difficulty, but when Mns. Nelms' put
Davia out same of the men persuaded
a few ladies to remain and the
dance was started again. It was not
long, however, before Davis re-entered

dancing, as he liad paid 75 cents 'to

nor.ee of him until he tried to dance
and succeeded in breaking up the ball.
About this thno several young men,
one of whom Was Ed. Walthall, who
had loft the dance when Davis became
so disorderly, started back into tlio
house. Davis nidt them and began
oursing them. Walthall remonstrated
with him, but 'Davis grew abusive and
made h's remarks personal to Waltha ll.
The crowd walked away from the
bouse to the centre of the street, where
Danio' sbuse of Walthall' grew so
violent that Walthall stopped und told
him he bud said enough. Davis then
drew Ills knife, which he opened and
held In his right hand, while he struck
Walthall In the lace with hie left
hand. As ho did so Walthall gave a
step backward, puiltld his pistol from
his overcoat pocket, raised It above his
head, nnd quickly lowering It to a
level with Davis' breast, tired. Davis
turned, <irad Walthall’s brother, who
stead lust behind him, said, “Ed, don't
a hoot him any more.” but tlio words
were hardly out of bis mouth before
Walthall tired two more shots in rapid
succession. Davia walked about- ten,'
feet and fell on his face, aome of the
men present tutu, to him. buit he was
dead the moment ho struck tile ground.
After the shooting, WhithaM with
aome of his friends walked oft, but
before leaving Wnltha'.l culled back to
tiie crowd, saying: “If they want me
tell them I am at home.”

on the scene. Just thirty minutes after
tho killing, he found Oononer Knight

the body home, where an inquest w..-
staortly afterward commenced. Davis
was lying face downward with nk nlft

the knife being stuck In the ground.
The hand was not closed down on the
knife. In a little house near by could
be heard the lamentations of Davl3’
young wife, amd later on, when she
came out and, standing in a nickering
light, cried aloud over the pale, ghastly
face of her d«ld husband, the scene
was a sad one.
Coroner Knight suMmionod a Jury,
after which an examination of llhe body
was made. Only one ballot hole was
found In the body, although ■there wore
(two dn tihe back of the coat. Neither of
theso bullets, however, took effrot.

about an Inch from the left nipple,
and from tho angle of the IboJe there
was little doubt of Its 'having penetra
