L. A B. FllENKEL.
In the United States court yesterday
Judge Bpeer signed a dtefee for fore
closure and sale of the electric street
railway of Savannah.
The decree was asked for by Receiv
ers John It. Young and J. 8. Collins,
and Mr. Walter O. Charlton, who repre.
oents the company, and CoL William
Garrard, representing the Oglethorpe
Savings and Trust Company, trustee,
all of whoih agreed on this mode of
procedure.
The reports from the receivers show
that the property has been far more
successfully operated since It has been
In the hands of the court than waa tho
casa prior to that time. The report
for the alxlccn months of the rccclver-
slilp show net earnings of considerably
over $5,000, which Is about double that
for the sixteen months prior to that
time. Hut, as will be seen, It requires
about $35,000 or more,to pay sixteen
months' Interest .on the bonds at r> per
cent., and there la considerable differ
ence between this amount and tho
amount of the het earnings actually
made. /
It Is not known that any particular
opposition will be made on the part of
tho company to the Halo of the proper
ty. Ah far uh can he determined, It
can only udmlt that the allegations to
the effect that the Interest Is due, has
been demanded, and Is’ unpaid. This
of course goes n long way In deter
mining the result. If the company can
not pay Its obligations, there Is nothing
for tt to da but to aubtnlt to the de
cree of the court. It Is not likely, how
ever, that any action will be taken
with regard to the sale of the prop
erty for somo weeks to come. The In
dications nro thcro may be a hearing
an to the ante In August, but nothing
dclllnlte with regard to that Is known.
Of course no estimate as to what the
road might bring can be made at pres-
cnt. There Is a good deal to be con
sidered In connection with the proper
ty outride of what It has done In the
past. Its conditions ore constantly Im
proving, but In order to properly econ
orplas the road itsoda oboist datable new
equipments, which the company In Its
present condition Is not able to put
upon It. Tho cost of carrying each
passenger Is about 3?i cents. This may
be said to bo the actual operating ex
penses, including taxes. Insurance and
■ill Items of expense that necessarily
cut a figure. <
A large amount of the travel, ns Is
well known, Is done at present at 3
cults, nml It will in- readily seen that
under these circumstances the proper
ty ennnot do what It should do. It
may be sntd that more people ride at
I cents than at't. but this baa b**n
demonstrated to be true only for n brief
period of time, an In tho end It had
been seen to be true that about the
samo number ride at 3 ns at 5 cents.
RECEIVER'S DAMAGES.
Margaret McAlpln, who was Injured
by the Central railroad nt the union
depot some ttmo ago, was given $1,500
damages, or. rather, a Judgment
ngalnst the receivers for that sum. The
case came up on a hearing of excep
tions to tho master's report, but tho
master was sustained and a Judgment
for th" al*'i\ .■ .im.amt given.
ATLANTIC 8HOUT LINE.
Judge Speer passed ss> order yester
day changing the time and place of
sale of the Atlantic Short Line. It
wns originally Intended Hint the road

but the order yesterday modified the
decree nnd changed the place of sate
from Savannah to Bwalnsboro, In
Kmanucl county, and the date of sate
from'Aug. 4 to Aug. 11.
Tho change of place of sale was made
In accordance with a recent oct of con
gress providing that such sales shall
take place in the county where the
greatest amount of property |s involve 1.

case of n North Carolina clergyman,
who writes:
"Hillsboro, N. C.—Gentlemen: Two
weeks ago I began to use No-To-Bac,
