Got. Atkinson Has Taken
Charge of Northeastern.
LONG LEASE KNOCKED OUT
AND SALE OF PROPERTY BY STATE
WILL BE EASY.
Lessees Failed to Pay the Rental Even
After Being Given Three Days of
Grace—Text of Governor’s Or
der Taking the Road.
Atlanta, May 6.—Governor Atkinson
has taken possession of the Northeastern
railroad.
The lessees, E. A. Richards & Co., de
faulted Jn the last quarter’s rent, and
Governor Atkinson, aCter having given
the lessees three days of grace, from
last Saturday, today signed an order
taking possession and naming R. K.
Reeves state agent to take charge of
the road, suhjeot to orders from the ex
ecutive department.
This disposes of the twenty year lease
held by Richards & Co. and snakes the
sale of the property Iby the state an easy
matter. The long lease was a serious
impairment of the marketable value of
the road, which was ordered sold at an
early date by the legislature.
The governor was waited on today by
Messrs. Lumpkin & (Burnett of Athens,
representing the receivers, and by others
representing the bondsmen , but no ten
der of cash, was made for the rental,
and after a conference with the attorney
general the governor decided that it
was better to take possession of the
road.
The following is the order:
“State of Georgia, Executive depart-
ment.—Whrsreas, I, William Yi Atkinson,
uh governor of Georgia, did on the 28th
day of May, 1896, lease flic Northeastern
railroad (a railroad running from Athena
ito Lula in said state), with all fta houses,
orUing stock, depots and appurtenances
nl every kind to E<1. A. 'Richards & Co.,
a firm composed of Ed. A. Richards and
James P. Harrison, for the term of twen
ty years from the first day of May, 1895,
in accordance with the provisions of the
Oct of the general assembly of Georgia,
• entitled ‘Air act to provide for the sale
or lease of the Northeastern raitroad, to
co&fei certain powers and duties upon
the governor with reference .thereto, and
for other purposes/ approved December
16,1895, *at and for .the sum of $18,600 per
annum, payable quarterly—that is to sa>,
one-fourth of said sum of $18,000 to be
paid at the expiration of every succes
sive period of three months from the loti
day of June, 1896, for and during the
continuance of said lease up to March 1,
1915, and the sum of $3,100 on 'April 30,
1915, and
“Whereas, the lease contract and the
*bond required o? said *«:t of December
16, 1895, were properly executed, ap
proved and filed in this office, and the
said Northeastern railroad and appur
tenances (all of which being particu
larly described and set forth in said
contract of lease) were turned over to
and placed in the possession of said
Ed A. Richards & Co. on the 1st day
of June, 3896, as provided in said con
tract; and,
t “Whereas, The said Ed A Richards
& Co., lessees as aforesaid, have failed
and Tefused to pay said rental quar
terly as provided said act of December
16, 1895, and also by said l*»asc contract,
land did on the 1st day of March, 1897,
fail and refuse to pay, as required by
said act and also said contract, the
quarters rental, viz., $4,650, due on the
1st day of March, 1897, ai.d have ftiled
and refused to pay same for a period
of more thn sixty days rtnee said first
day of March, 1897, and continue to
fail and refuse to pay same; and, 9
“Whereas, The said act of December
16, 1896, provides that “the rental shall
be paid quarterly, and the governor
may seize the road on failurd of the
. lessee® to pay same for sixty days after
any installment becomes due.'
“Therefore, I, William Y. Atkinson,
governor of said state, do Issue this
«ny proclamation, making known that*
I have this day seized and taken pos
session of the said Northeastern rail
road, and all its houses, rolling stock,
depots, shops and appurtenances of ev
en* kind leased to said firm of Ed A.
Richards & Co., as above set forth, to
the end that the same may be held,
used, controlled, operated nnd disposed
of, as provided by law;
“And that Rufus K. Reaves has been
appointed agent of the state to receive,
taka posseslson of, manage and con
trol, subject to orders from this depart
ment, all of the property seized as
aforesaid.

seal of the state at the capital in At
lanta, the 6th day of May, in the year
of our Lord 1897, and of the independ
ence of the United States the one hun
dred and twenty-first.

Grand Jury Concludes tlio Investigation
of the Broken Bank.
Atlanta. May 6.—Harry Casein, the
defaulting cashier of the Georgia Loan,
Savings and Banking Company, waa
before the grand Jury «thla morning.
Cassin was questioned about the con
nection of the bank w^th the property
that was recently burned In PitoWburg.
He testified that the property bad been
turned over to the tank.
It Ib underntood that he mndo no
charge* against the other ofr.clo.ts.
President G. V. Greys was also called,
and was questioned about the manner
In which the bank’s affairs were con
ducted. He stated that Mr. Casdn was
the active (manager and conducted the
operations of t-he institution.
The grand Jury, after investigating
the -case, failed to find Indictments
against any one else connected with
the bank.

ties and Receives $12,000 Cash.
* Atlanta, Ga., May 6.—A settlement of
Jtho litigation between the Southern
{Mutual Building and Loan Association
and the Iowa Life Insurance Company
.■was announced before Judge Lumpkin
.this morning and hie approval of an
order for ithe nett lenient was obtained.
By the settlement, the Iowa life re
turns to the Southern Mutual $111,000
of securities and receive $12,000 in mon
ey, which it has paid out In connec
tion with the contracts made with ref
erence to thesw securities.

a young and beautiful woman of Knox

little 5-yea.rd-old son by Mr. Charles
Pogue, who. she says, Is a heartless
husband, and has taken her offspring
from her and has hidden It away
where she cannot nnd t.
Mr. Charles Pogue to a wealthy real
estate dealer In Knoxville and Is well
known in Atlanta.
Tears streamed down the mother's
face a. she told tho chief of police and
the captain her story. She had already
been to the homo of the father of hex-
husband. Mr. E. H. Pogue, at 637
IVbodward avenue, and although she
made Inquiry, her father-in-law was
careful not to teU Where the object of
her search was concealed.
Several years ago Miss Hattie Mc-
Nabb anti Mr. Charles Pogue tun away
front Knoxville together. A month later
they returned. They l,ad been married
In Washington, D. C. But nearly three
yeans ago Mr. and Mrs. Pogue eepa.-
ted and the kept the child. The little
boy remained a.t Mrs. MeNabb's until
a few weeks ago. when the husband Is
said to have kidnaped it and brought
it to Atlanta.
Mrs. Pogue tried to have a warrant
Issued for some member of Mr. E. H.
Pogue's family before Justice Foute,
hoping to get possession of her child
in this way. hut the Justice refused to
Issue the warrant. It Is understood
that they are In consultation with at
torneys. and will make a legal light.

for the meetings of the conference oom-

wick. The other members are Mr. A.
O. McConnell, general passenger agent
of the Florida Central and Peninsula,
and Mr. J. C. Harle, general passenger
agent of the Central of Georgia Hall
way.
Chairman Richardson, of the con
ference committee, has drawn up a act
of rules to be submitted to the com
mittee as a suggestion. The action
taken today will be passed on by the
conference eoennilttee which meets here
on the 18tr» Inst.
Any rules adopted will neceesar.ly
eliminate the old feature of oontrol by
the association and the rules will prob
ably be brief and simple.
The new association Is yet In the
formative stage, and its methods ot
operators will not -be fully shaped un
til the conference committee meets.
The freight oonference committee

Detective I.noncy Indicted.
Atlanta. Ga., May G.—Dave Looney,
city detective, was Indicted by the
grand Jury this morning for assiult
and battery on the person of Bill Harp,
a gambler. The alleged offc-nse was
committed some weeks ago at police
headquarters, while Harp was under
arrest.

Savannah, Ga., May 6.—William
Murray, an old man, fc;nu.!y Janitor
of the Cathedral of St. John tho Bap
tist of this city, but who has been
keeping a little store at Levy's cross
ing, about eight miles from Savannah,
was found murdered in his store last
night. His head had been smashed in
with some heavy Implement and his
throat cut from oar to car. The
store had been robbed and 'the old
man’s pockets rilled. The crime Is sup
posed to have been commltteed early
yesterday morning. The old man lived
alone, and when his store remained
closed during th? day It was supposed
he had gone to Savannah to trade.
OBITUARY.
John C. Dell.
Savannah, Ga„ May 6.—John C.
Dell,-a prominent lawyer and leading
citizen of this section, died this morn
ing at his home In Sylvanla of apo
plexy. Col. Dell had represented
Screven county In the legislature and
was a prominent Democrat. He was a
delegate to tho national Democratic
convention of 1892.
Mrs. T. H, stout.
Thomaston, Ga., May 6.—Mrs. T. H.
Stout, wife of Rev. T. H. Stout, pas
tor of the Baptist church here, died *t
G o'clock this evening. She was the
victim of a stroke of parlysls Met night
and It seemed she would die then, but
She rallied and lingered until this
evening.
Mrs. Mattie Hampton.
Fort Valley, Ga., May 0.—Mrs. Mat-
tie Hampton, who resided near here,
died laat night at 8 o’clock of penumo-
/nla. Her death was sudden and quite
a shock to her many friends. She was
the wife of Mr. Jake Hampton and her
maiden name was Causey. She waa
about 30 years old and leaves a hus
band and one child. She was burled
here this evening at SdO. o'clock at
Oak Lawn cemetery. Her remains
were followed to the cemetery by one
of the largest funeral processions that
this place has ever wltncssed.
Emory C. Pharr.
Gainesville, Qa., May G.—Mr. Emory
C. 'Pharr died suddenly, almost, here
yesterday evening at «:30 o’clock. He
had been sick only a short while, be
ing taken with terrible convulsive pains
in the bowels, and died of what the
doctors termed Inflammatory derange
ment of the bowels. Mr. Pharr was a
prominent young business man and has
been the correspondent of the Atlanta
J.jumal for a long time. He leavoe a
wife and child and many friends to
mourn hi* death.

Waycross. Ga . Mry The annual
picnic of the Waycross Rifles will be
held tomorrow at Green Cove Springs,
Fla. A apodal train has been engaged
for the trip. The train will leave here
at 6:16 a. m. and reach Jacksonville
at 8 a. m., when the Rifles and their
friends will bo transferred to a St.
Johns river steamer for the springs.
The picnic party will remain at the
springs from 10:30 a. m. until 4 p. m..
reluming on the boat to Jacksonville
and reaching Waycross at 8:30 p. m.
A splendid programme will be carried
out at the springs. The Rifles will be
welcomed with a speech by Mayor
Brown of Green Cove Springs, and a
member of the company will respond

The Waycross Herald states that the
shops o' the Plant system at Savan
