an Important decision In the Rogers u

Roger* and V. C. Joiner, bankruptcy
caaea. The cases have been before tho
referee for many montha and were con
tinued from time to time, several tlmett,
and certain questions were argued be
fore him at various times.
Finally all the various details and
questions were exhaustively reviewed,
requiring two days of the court's time-
Thera wars so many points to be de
cided and the evidence so voluminous
the referee reserved his decision until
be could go over the books, documents
and other evidence, and consult leading
text-book authorities und supreme court
decisions touching ths questions ut
issue.
The amounts realised by the sale of
the asset! of the Rogers ft Joiner Com

the Individual estate of D.* C. Joiner
the sum of I2S.02o.1I, making a total of
$w0.0S5.lt. After deducting expenses of
court, etc., there Is left the sum of
$17,224.12 for distribution.
Referee Proudflt’s conclusion! of law,
after atatlng the case, are as follows:
“Section &,* paragraph f of the bank
ruptcy act of ISOS prescribes that the
net proceeds of tne partnership prop
erty shall be appropriated to the pay
ment of partnership debts, and the net
| proceeds of the Individual estate of each
partner to the payment of his Indlvl-
| dual debts.
| “Should any surplus remain of the
property of any partner after paying
his Individual debts, such surplus shall

applied to the payment of the partner
ship dtbts. Should any surplus of the
partnership property remain after pay
ing the partnerships debts, such sur
plus shall be added to the assets of the
Individual partners‘In the proportion of
their respective Interests in tbo part
nership,
“Construing that portion of the
tion above referred to, and the line of
authorities cited as to its prop
structlon, my opinion Is that congress,
in establishing a uniform syi
bankruptcy throughout the United
States, clearly Intended .that which said
section Implies, vts.: that If D. C. Joi
ner hod Individual creditors, they
should be paid out of the Individual SS'
sets, and should such assets exceed the
amount n^c'cesary to pay Ms Individual
debts, the surplus should be added to
the funds belonging to the partnership,
and the fund thus arising be divided
among the partnership creditors. Tho
