Hon. Jno. T. Holfeulllet. Clerk of the

In receipt of your Inquiry of this day,

not appear in section 21 at all, but doe
appear in section 22. The amendment
proposed sought to strike a provision
relative to the sale of liquor in the
ordered that j town of McCaysville in the county of
Fannin, the purpose of the bill being
to Incorporate that town. The senate
amendment was after conference
agreed to In the house. In re-engross-
Ing and enrolling the bill the question
you raise Is suggested, that Is to say,
whether you may apply the amendment
to section 21 nr to section 22. The dif
ficulty consists in on Inaccurate de
scription of that part of the bill the
legislature sought to amend and though
It called It section 21 the undisputed
evidence Is the amendment related to
eectlon 22. A11 inspection of the bill
shows that section 22 was the section
proposed to be amended. The subject
matter of the amendment la also un
disputed nnd the bill Itself bears the
physical marks that It was the latter
part of section 22 sought to bo amend
ed. for that it In Inclu.led within
brackets. The author of th*» bill nnd
the officlnl In the senate concede that
It was section 22 Instead of section 21
to which the amendment related. No
body claims that it was the intention
to amend section 21 and nobobdy dis
putes but what it whs section 22 the
legislature sought to amend.
I, therefore, unhesitatingly advise
that you treat the amendment and np-

a county school commissioner should
