Interesting Aspect.
The suit of the city of Macon against
the Macon Railway and Light Com
pany, which was to have been heard
before Recorder Nottingham yeaterdny
evening at 6 o'clock, waa deferred on
account of the Illness of Mr. Hertx, the
manager of the railway and light com
pany.
The charges ngalnst the street rail
way company were entered by Aider-
man Ben L. Jonea, who la chairman
of the street committee of council. He
had complained to council that the
company waa acting In bad faith and
had not compiled with contracts as
embodied In one of the city ordinances.
The statement of the chairman of the
atreet committee waa made In open
meeting of council and’ the alderman
asked what procedure he- should take
to have the tracks of the company put
on a level with the surface of the
streets and pavement. He had also
made complaint to council that the
tracks In tha middle of Poplar atreet
were yet not in use by the street rail
way company, but no action waa Im
mediately taken In regard to thla
matter.
On last Tuesday night a petition
from the Macon Railway and Light
Company waa presented to council
asking that the enforcement of the
contract which required the Immediate
use of the tracks In the middle of
Poplar street be postponed until after
the state Pair In October. Thla peti
tion waa roundly dtacusaed and passed
over the objection of Alderman Jonea,
but the matter of keeping the tracks
level with the surface of the streets
waa handled by the alderman and he
made a case agnlnat the manager of
the company.
Thla case waa set for yesterday af
ternoon and Waa delayed on account of
the lllneaa of Mr. Herts. No date for
the hearing was arranged yesterday,
but It will come up for assignment at
this morning's session of the recorder's
court. At this time It will be deter
mined when the hearing will be had.
The charges against the manager of
the street railway company are at
tracting attention In tho city ond
many are concerned aa to the outcome
«»f the trial before the recorder. It has
been stated that this suit may go to a
higher court, but nothing has yet been
done and the heating will bo had be
fore the recorder when the dnte ar
rives. The street railway company
has arranged to defend themselves at
the trial before the recorder and It la
likely that the case will afTord matter
for a more than ordinary legal contest.

STUDENTS ARRIVING
FOR MERCER’S OPENING

of tha Faculty are Also in Macon—
Mercer on Eve of the Greatest Open
ing in Its History.
Students are beginning to arrive for
the opening of Mercer University
which occurs next week. They are
gathering on tho campus and making
arrangements to be In readlneaa for
the work which begins next Friday.
Although It la early for their coming,
there are many of the students of last
year arriving at thla time.
Many students will be on the campus
by Monday. All members of the fa
culty will be In the city In a short time
ready to begin the new college year.
Professors Macon and Hollars and Dr.
Ragsdale came In yesterday from their
summer vacations and ore now busy
with arrangements for the opening.
All departments of the Institution
will be largely attended this year. The
reports of the summer work show thnt
Mercer will be crowded at the open
lng and It Is already known that the
number will reach above that of any
previous year. The imports of stu
dents for the new department of phar
macy are indeed promising and Prof.
Hellers stated yesterday that he
sure of not less than fifty men at the
start In this department.
The student attendance at Mercer
for the nppro.ichlng yo*ir promises to
reach far above 800 and A*Ice President
Kilpatrick, who has kept in close touch'
with the situation, claims that there
Is no doubt that Mercer University la
entering upon the greatest year of Its
history.

It has been stated by one of the
prominent citizen who has seen the
material for the advertisement that
this city Is now making a showing at
the World's Fair equal to any othe.r
city of Its size and advantages. There
(s yet a considerable time before the
fair closes and those who have pre
pared for Macon's Interests state that
theru Is yet ample opportunity for
great profit to Macon and this section
through the work which has been
done.

ST. PETERSBURG, flept. 16.—The
Associated Press Dltspatch from Muk
den announcing that, according to In
formation from Chinese sources, the
Japanese are leaving a garrison at
Liao Yang and their main forces are
moving out on the Russian flanks. Is
partially confirmed by the dispatch
from Gen. Kuropatkln reporting that
the Japanese are massing on the Rus
sian flanks, that- a large force la con
centrating at Bentslaputze, twenty
miles southeast of Mukden, and an
other force, whose strength which has
not been established, Is moving up the
Liao Valley. The greater part of Field
Marshal Oyama's army, however, la
still near Yental. encamped along the
heights between the mines and the
railroad.
The United States Health Bulletin, the American authority
on matters of health, sanitation and hygiene, in its issue for
May, 1904, contains the following editorial comment:—

did catches. Early yesterday morning
he "caught" a man-eating shark that
weighed 700 pounds, and which In the

been wounded unto death, required six
men to pull out of the water. The
shark wns sent to New Orleans yes
terday from Bayou Dea Alletnandea,
and attracted hundreds of visitors to
the establishment of the Pelican Fish
and Oyster Company. In South Ram

during the nfternoon. says the New
Orleans Times-Democrat.

with forgery and the embezzlement of
auma amounting to $25,000. Frank
O’Donnell, an . 18-year-old boy, waa ar
rested today at the Brighton Beach
race track upon the complaint of Ed
ward H. Floyd-Jonea, a lawyer In
whose office he waa employed until a
few daya ago. Young O’Donnell waa
found by the police to be doing a good
business aa a bookmaker, having In
his employ hnlf & dozen sheet writer*
and runners. He had been missing
from Mr. Floyd-Jonea* office alnce
September 7. He la charged with
raising his salary check and altering '•
figures In the hooka of an estate with
which he had to do in the office of his
employer.
