dict for Defendant.
The superior court of Bibb resumed
work on the civil docket yesterday
morning and the hearing of two cases
has consumed the day. The damage

trnl of Georgia railroad was taken up
at the opening nnd continued through

defendant.
The cnee war brought In the nuperlor
court over a year ago but wai non
suited when It came up for trial. It
waa taken to the state supreme court
and the action of the lower court was
reversed. A trial was given nnd the
hearing yesterday was the result.
The plaintiff had asked $5,000 dam
ages on account of alleged injuries said
to have been sustained* on Cherry
street in this city by being struck by
a hand car while In the, employment
of the railroad. The defense claimed
that the petitioner waa not In the em
ployment of the roa<\ at the time the
accident occurred and on these grounds
the case was non-suited some time ago.
The Jury gave the verdict to the de
fendant after a strong fight was made
to show that the petitioner was not
in the employment of the railroad when
the accident occurred.
The injury sustained was caused by
the falling of a heavy beam of timber
on the foot of the plaintiff. He charg
ed that the hand car knocked the beam
upon his foot nnd thus injured it per
manently.
The remaining part of the day was
devoted to the hearing of the suit of
R. L. Anderson, administrator, against
Nannie Emerson and D. L. Bullard.
The administrator la suing for a small
body of land in the Howard district of
Bibb county. This suit was not ended
at the close of the session of yester
day.
