City Attorney Mlnter Wimberly
turned yesterday from Washington, where
he went for the purpose of representing
the city In the case of J. W. Toney and
others who appealed to the supreme court
of the United States in their effort to
enjoin the annexation of the new terri
tory In Vlneville and Huguenln Heights.
The appeal was heard In the supreme
coutr on Monday, and a decision will
probably be announced on next Mon
day.
Attorney John R. Cooper for the com
plaining citizens was not In Washington,
but filed his answer to the motion made
to dismiss the appeal by Attorney Wim
berly. This motion for dismissal con
tained several reasons for pursuing this
course, and the city attorney, while not
assured of winning, was very confident
on his return yesterday.
The answer made by counsel for the
complainants denied the statement in
the motion of Mr. Wimberly that the ap
peal was made for the purpose of delay.
The answer consisted wholly In denials
of the assertions made by the city attor
ney in his motion to dismiss.
The decision will not be reached before
Monday next and may he delayed further,
but within the next few days the result
will be known, and steps can then be
taken accordingly in Macon. Tho city
attorney has hnd confidence In his abil
ity to defeat tho efforts lo prevent the
annexation of the territory since the first
apQea! was made and since going to
Washington. he still believes the decision
will be made for the city In the annex-
tlon of the territory.
In the event of defeating the appeal,
steps will be taken nt once to place all
citizens In the new territory on the snmo
footing with other sections of the city.

Death of Father of Mrs. Richard John*
ston of Macon.
ATHENS. Ga., Nov. 30.—Cftpt. Wil
liam W. Thomas, president of the
Southern Mutual Insurance Company,
died today at noon at his home in this
city. He had been quite til for over
two weeks and his death was not un
expected. He had been for some time
suffering with a tendency to severe
convulsions.
CapL Thomas hnd been for twenty-
nine years connected with the South
ern Mutual, having been its president
for the past ten years. He was a
member of the commission that built
the state capitol, having been appointed
to that position by Governor Gordon.
He was a member of the Presbyterian
church. He Is survived by his wife,
who was Miss Palema Brown, and by
his two daughters. Mrs. Richard John
ston of Macon and Miss Gertrude
Thomas of this city. The funeral will
will be held Friday morning at 11
o'clock at the Presbyterian church In
this city.

circular note to the powers of October
23 last, Inviting them in the name of
the president to reassemble In confer

postponed work of the first confer
ence," was delivered verbally to Se
cretary Hay today by Count Cassini,
tho Russian ambassador. Tho ambas
sador was requested by his government
to say that Russia heartily accepted In
principle the Invitation to a second
conference at Tho Hngue and gladly
associated herself with the American
government In its effort to cotnpleto
the mission of the llrst great assem
bly convened under the leadership of
the Russian emperor. The ambassa
dor was further requested to say that
while the Russian government very
sincerely cherished these views. It did
not consider the moment opportune for
tho convening of such a conference and
It therefore must withhold Its formal
acceptance of the invitation until tha
war in tho Far East was at an end.
