At all events the esse promises to be
a hard fought one. Should a plea of
Insanity be entered It would not he
surprising as many stated yesterday
that witnesses could be obtained who
would swear the defendant was of an
unsound mind and In great measures
not responsible for his nets.
Owing to nn absence of witnesses at
the Recorders' court yesterday morn
ing the preliminary trial of HchofieUl
was not held, but was postponed until
this morning's session, \yhen the time
for the opening of the court yesterday
arrived the visit ora* benches were well
filled. Not only were acquaintances of
the defendant present but a Urge
number of negroes.

The dead body of John Remley, th^
man who has been* sought all through
Georgia by a number of officers, has
been four.d near Austell. Ga. Chief of
Police Hcott Steele of Crawfordvllle,
Ind., was in the city yesterday in
sedrch of the misting man And has
been Informed of the discovery. Tho
news was first broken to A. E. Tlnk-
hatn, n nephew of the dead man, who
hud come South tb assist the Craw
fordvllle chief of - police In searching
for him.
A section foreman on the Southern
railway near Austlll found the body
neatly two hundred yards from the
tracks and the rttyktery Is deeper than
ever as to how hi' come to hls death.
The theory was advanced that tho
aged man had stepped from the plat
form of the Pullman ear while en
route from Rome to Atlunta. This la
little believed now on account of tho
fact that he was go far from the road
when found.
There was little to Indicate how Mr.
Remley ytnet death. The Associated
Press raport from Atlanta states that
It Is supposed he walked from the plat
form In a fit of Insanity or during an
attack of somnambulism. It has been
suggested that ho might have fallen
and become seriously Injured but not
killed outright. In this event he could
have wandered from the road before
ho died of hls injuries. No evidence
of foul play Is reported by the section
foreman who found him.
The nephew, who was tn Atlanta In
seurch of the missing man, went to
Austell and took charge of the dead
body upon being notified of the dis
covery. The members of the family,
who had continued the Journey to
Jackson ville, F1« 7 have also been
titled of the discovery of the dead
body.
Mr. Remley and hls wife had started
to spend the winter In Florida In com-
pahy with a brother and hls wife. Mr.
and Mrs. Daniel Remley. No member
of the party discovered that Mr. Rem
ley had left the car for some time.
The train kept on the Journey and the
other three persons went on to Jack-
sonvllle. After he did not show up a
search was begun and resulted In the
ghastly find of yesterday. The body
was discovered early yesterday morn
ing.
The Crawfordvllle chief of police
supposed that he had searched the' line
of railroad over which the deceased
man had traveled thoroughly. He had
notified the police of Macon and the
theory was advanced that he had fallen
from the sleeper Into the Ocmulgee
river In Macon as the train passed
over. All this has be*n cleared up and
It now develops that there was no Ms.
con end to the story. No effort was
made In this city to locate the missing
man until the Crawfordvllle chief
police was here yesterday.
The searching party will take charge
of the body and the families will re
turn to Crawfordvllle on the sad mis
sion which has been the outcome of the
trip South. Mr. Remley was about 72
years old and was a man of considers
ble means. He owned farm lands near
Crawfordvllle Ind.

We own and control
cornfield by a farmer, about 100 yards
front the track* of the Southern rail
way. It showed a concussion of the
skull, which Is likely to have caused
death, also many bruises about the
body. The body was clothed In the
usual garments, excepting a coat. In
the pockets were found about $18 In
currency and change nnd also New
York exchange for $600 payable to
John Remley. It uppeared that the
man had fallen from a paslsng train,
struck on the nead and had wandered
the short distance before succumbing
finally to the wounds that caused
death.
A coroner's jury found a verdict In
accordance with the facts stated de
claring that death was due to acci
dent. The body has been embalmed
and will be tent to the Indiana bomb.
