JOINT RECEIVERS
IN LUMBER MILLS
FUNDS FOR POOR

FIRE LAST EVENING
BURNS SUPPLY CARS
Judge .Speer Yesterday Appointed
Messra. Alfred Short and S. J. Tin-
thoff to Take Charge of Erio Lumber
Company.
Judco Emory Speer yesterday ap
pointed two receivers In the Erie Lum
ber Company at Lumber City. This
caae has been In the federal court for
some time and involves a large amount
of property. The first entry In the
court was made when the creditors
asked for an adjudication In bankrupt
cy. Yesterday two of the principal
stockholders in the buelneas were ap
pointed co-receivers and will be put
in charge to conduct the business.
These were Messrs. Sylvester J. Tln-
thoff and Alfred Short.
They had been contesting the case
for some time when they finally reach
ed an agreement and returned to the
court to ask that they be appointed
to operate the business further with
the hope of paylng'off the indebtedness.
They were appointed and placed under
bonds and returned to start the mills.
The appointment of the receivers Is
similar to the action of the court In
the Mlggston lumber mills some time
ago. In the former Instance the busi-
paid out of debt and there never
was an adjudication. This statement
was made by one of the officials after
the appointment of the receivers yes
terday, and he believed the ErIe<Lum-
ber Company will be able to pay out
without and adjudication.
It Is said that coses of this kind have
been very frequent in the federal courts
of Judge Speer's Juridlctlon. Receiv
ers have been appointed In many In
stances and the business has been al
lowed to work out of debt. In the or
der which he sighed yesterday he re
quired the receivers to report monthly
and notify the court Immediately up
on any failure to make the business
pay running expenses and lay aside
clear earnings.
