Joe Watts was acquitted yesterday
by a Jury of Wilcox County, *n one oi
the most strongly fought crlrjid&l trials
In the annuls of tho county.
Watts was charged with tho killing
of Orrln and Pete McDuffie, two orviii-
ers, near RnchoJlc. February 19. I:'"'.,
He was first tried before Judge Martin
and convicted of voluntary manslaugh
ter and was given a term of twenty
years in the penitentiary?
A motion for a new trial was made
In tlie case. Judge Martin granted
a new trial. The defendant was again
put upon trial before Judge U. V.
Whipple, in September. 1507. Judge
Whipple charged that it was either 4
case of murder orjustlflable homlcldj.
The jury ' evicted him of voluntary
manslauglit and sentenced tho defen
dant to fife *4 years In tho peniten
tiary. **
His counsel appealed the case to the
Court of Appeals of the State of Geor
gia, on the ground that there wa» no
manslaughter in the case, that It was
• it In r a v ise of Justifiable h<>mivld, ; ui*
murder. The Court of Appeals revers
ed the care on the ground that there
was no manslaughter in the case.
The defendant was put on trial for
the third time last Monday in Wilcox
Superior Court. Judge Whipple presid
ing. It ended In his acquittal. Tho
case was prosecuted vigorously by four
solicitor generals. Col. D. B. Nichol
son. Frank Hooper, Hon. Tom Eason
and Walter F. George.
The defendant plead gclf-defcnse. Ho
showed that his life had been threat
ened on manv occasions by thu Mc
Duffie brothers, and that when ho shot
them both down he did so In order to
save his own life. They had pistols
drawn upon him. The State claimed
that he shot them down for nothing,
making a clear case of murder, but the
Jury decided in favor of Watts and
gave him his freedom.
He has been In Jail for thirty-three
months, and during tho time worked
four months in the Georgia peniten
tiary at Broxton.
This one of the most Important
eases ever tried in Wilcox County. The
defendant was represented In all tho
trials by John R. Cooper, of Macon;
H. D. D. Twiggs, of Savannah: Co*
T. C. Taylor, of Hawkinsvllle; A. C.
Holt and Hal Dawson of the local bar,
Abbeville.
