traffic. An appeal to the United States
supreme court is being prepared.
Tho full text of the decision dis
closes. in the language of tile Judges,
the gradual development of judicial
Interpretation of the law up to the
present time. Judge Coxe. one of the
concurring judges stating that "Since
the Knight case (against the sugar re
fineries), the tendency has been con
stantly towards a wider scope of the
statutes."
An exsmlnntlon of the numerous de
cisions since the Knight cose leads to
the conclusion. Judge Coxa says, that
there has been a general tendency to
wards a b. oader and more liberal con
struction of the statutes.
Status of the Law Today.
Judge Lacombe, In his majority
opinion, defines the status of the law
today In part as follows:
"By Insensible dcgrocs, under the
operation of many causes, business*
manufacturing anil trading alike, haa
more and more developed a tendency
towards larger and larger aggri-iX-
tlons of capital and more extensive
combinations of Individual enterprise.
It Is contended that, under existing
conditions. In that way only enn pro
duction be Increased and cheapened,
new markets opened and developed,
stability Jn reasonable prices secured
and Industrial progress assured. But
In every aggregation of individuals or
corporations, formerly Independent, Im
mediately upon Its formation termi
nates an existing competition: whether
or not some other competition may
subsequently arise.
Fine Points of Law Defined.
"The act as above construed, pro
hibits every contract or combination
In restraint of competition. What
benefits may come from this combina
tion. or from others complained of. It
la not material to Inquire, nor need
subsequent business methods bo con
sidered, nor the effects, on production
or prices."
Judge Moyes, who concurred with
Judge Lacombe, aays: "It la of much
importance to many people at the

bination. It is of tho most momentous
Importance to all the people for all
time whether the national government
has power to reach Industrial combi
nations dealing across state lines. All
must agree that conditions may arise
In the future requiring legislative ac

Smith, agsd 2S, of Richmond, Va., was
found dead In the old suits rock quarry
in the suburbs of Rsleigh this afternoon
under circumstances which lead the po
lice to helievs that he was robbed and
murdered.
Smith, who travels for the Whits Oak
Coal Company, registered at ths Tar-
borough House Friday afternoon In an
Intoxicated condition. He paid his bill
In advunce and was known to have had
considerable money.

The first annual banquet of tho
Mercer Nu PI Betas was held at the
Plaza hotel Saturday night and was
attended by every member of tho
chapter.
The local N. P. B. organisation i»
composed of membpra of ths Mercer
law class, and Is the "frat" society
that has been conducting Its Initia
tions on the streets of Macon for the
past week. There are eleven mem
bers, nil Georgia boys. Those who

GREENVILLE, Ga., Nor. IS.—For
the second time within two weeks
great grief has fallen upon Greenville
and Meriwether county on account of
the' death of an honored citizen.
At 12 o’clock Friday night death
Invaded the ranks of the old veterans
and claimed one of the most honored
members as a victim.
Mr. Robert D. Adair, county treas
urer of Meriwether for more than
twenty years, who, with the exception
of three yearn* service In ths army of
Virginia, spent his life In Oreenville,
has passed "over the river."
Mr. Adair enlisted In 1*11 In the
Eighth Georgia regiment, was wound-
ed, and lost a leg in thq battle of
Gettysburg In July, 1891, which put
him out otaervlce.
After the war Mr. Adair engaged In
the mercantile business until elected
treasurer In 1188. Two years ago he
suddenly lost his eyesight and con
tinued totally blind until death. On
Friday night h* suffered a stroke of
g sralysls. from which he died In a few
ours. His popularity was attested
b> being twice re-elected since fre
became blind.
His wife. Mrs. Willie Ellis Adair,
and two only daughter*. Mrs. J. W.
Chennle. of Atlanta, and Miss Irene
Adair, survive him.
The negro highwaymen are getting In
their work now. But they are after their
own kind.

ment that no engagement exists be
tween his daughter, Miss Katharine
The statement was made with tho
knowledge and consont of Miss Elkins,
who desired that tho announcement
should be given to the public which
has manifested so great an Interest
the matter.
Elkins arrived in Washington from his
West Virginia home today. Aeked if
he cared to make any announcement
concerning the reported engagement of
his daughter, ho dictated the follow
ing statement:
"I do not care to say anything fur
ther than that my daughter and the
Duke DoAbruzzI are not engaged to
be married, and that I regret exceed
ingly the annoyance that must have
come to the duke and his family by
reason of the almost dally discussion
of the matter in the press and the
constant publication of rumors for so
long a time—rumors which I venture
to hope will now cease."
