Objeetion Made to Granting of Dis
charge in Bankruptcy to Frank
Gunn—Two Moonshiners Pardonsd—
Henry Kaplan Naturalised.
The auJt of R. F. Wimberly, trustee,
v*. D. F. Gunn, was argued before
Judge Emory Speer In the United
States court yesterday morning. Hear
ing was also given the objection to the
dlNch&rfe in bankruptcy of Frank
slon will be rendered today. The suit
Is on old one. having bc**n Instituted
more than a year ago.
R. F. Wimberly, trustee, charges
that Frank Gunn In filing his peti
tion for voluntary bankruptcy did not
give a complete schedule of his assets,
omitting mention of land owned by
him at the corner of Fourth and Pop
lar streets. Formal objection was then
entered to a discharge being granted
Gunn, and at the some time a re
straining suit was brought against D.
F. Gunn, father of the petitioner In
bankruptcy.
Naturalization papers were granted
Henry Kaplan In th” federal court yes
terday morning. He gave Russia as
his native country, but swore future
allegiance to tho Stars and Stripes of
ths United States.
The clemency of the court has been
exercised In tfia cases of Neal NJx,
of Thomaaton, and Nathan Brown, of
PInehurst, charged with operating Il
licit stills. The two defendants were
convicted In tho United States court
l&st spring, but as both had crops that
needed attention Judge Bpcor held up
aentence. They appeared before- the
court yesterday morning and stated
that thoy were ready to begin their
sentences. Judge Speer Imposed a
aentence of a year and a day tn the
federal prison upon each, and then
•pardoned them with a reprimand. The
two moonshiners, who appear to be
very respectable farmers, were profuse
In their apologies.

Jones, tried before the police committee
of council, charged with conduct unbe
coming officers, was handed down yes
terday afternoon during the progress of
the hearing of Brevet Jaleut. Watson on
the charge of refusing to arrest a citizen
them, If they so desire, be

both men tendered their verbal resigna
tions to Chief Westeott.
Lieut. Moseley said last night that he
did not yet know what he would do.

said thnt while in this particular Instance
he considered that'the officer waa negli
gent In hls duty, he had never found
any fault with him heretofore. Bo far

toward the officer, and seemed Inclined
to have the charge dismissed.
The committee, after going Into execu
tive session, soon reported that the case
wss dismissed.

torney Hall and Chief Wsstcojt.

thieve* might have become conscience
stricken nnd brought the roods beck,
but the one who made hls entrance Into
the store by means of twisting the
Iron bars in one of the ventilating
windows of the cellar and prising the
timbers of the trap door, was not of
that kind, and he carried nothing
back. So far. it ts a dead loss to Mr.
Bloch.
