LONDON. Dec. 17—Alarmist rumors
have been In circulation In London re
cently with regard to the health of
King Kdvard. but It was learned to
day that the condit'on of his majesty
1h not such ns to cause uneasiness to
the member* of his household.
Some week* ago. while a guest at a
country house, hi* majesty hud to
forego talking on account of the re
uniting irritation to his throat, but
other w'se he apparently enjoys hhF
usual health and he shows no signs
of the serious ailments that have been
hinted at. Following the day he had
to stop talking the king sat up and
played bridge and smoked his cus
tomary mild cigar.
When the king was at Biarritz, cer
tain winds resulted in a similar throat
trouble and other persons at Biarritz
complained of the same thing. Tho
king's ailment has been described by
a member of h'a entourage an a "Biar

JUROR liB
OF ALLEGED RIDER
STATE'S ATTORNEY DISCOVERS
THIS AND TALESMAN IS SET
ASIDE.
UNION CITY. Tenn.. Dec. 17—Two
unexpected surprises sprung by the
state on tho second day of the trial
of lb* eight alleged night riders, in
dicted for the murder of Capt. Quen
tin Rankin, resulted In the completion
of tho Jury 4his afternoon and will
shorten tho time of the trial.
Tho state caused consternation as
soon ns court opened by filing »n af

for tho prosecution, charging J. H.
Russell, tho first of the two Jurors
chosen yesterduy. was the father of
a night rider, and had been sworn
Into the outlaw bund by one of the de
fendants now on trial. The son is
Chan. K. Russell, and Attorney Gen
eral Caldwell declared that tills son
hud participated in several of the mid
night rides of tho band and would bo
used as a witness at the trial. He
told the court that this knowledge of
tho relationship came to him after h«
had accepted the Juror. Juror Russell
admitted his relation to Chas. Russell,
and was excused by the court, over
the protest of the defense.
Legal Quibbling.
When tho next tnlcoman was an
nounced and examined, the defense
attempted to challenge him peremptor
ily. The state raised the point that
the defense* having used 26 peremp
tory challenges, bad exhausted its legal
number and two more. Attorney Qen^
eral Caldwell admitted that each de
fendant was entitled to 240 challenges,
hut suld that when on a Joint trlul the
defense did not specify on behalf of
which defendant It made challenge. It
was presumed to have made each chal
lenge. upon behalf of each defAidant.
After a long and bitter argument, the
court promptly ruled with the state,
and ordered the case to proceed. The
work of selecting the Jury then pro
ceeded rapidly to a conclusion. Just
half of the Jurors are cltiz- us of Union
City, the others being residents of
towns In the vicinity. Not a single
resident of the Roel Foot Lake region
was selected.
