THE WITTY FUNSTERS.
A November Evening.
The autumn night U dark and cold;
The wind blows loud; the year grow* old;
The dead leaves whirl and ruatle chill;
rhe cricket's chirp U long and shrill;
The akies that were so soft and warm
Mutter and bode of gathering storm.
And now, within the homes of men
The sacred heart-flu-s gleam again,
And Joy and cheer and friendship sweet
Within the chanued circle meet
The children watch with new delight
The first Are, dancing redly bright.
That drives away the <lark and cold;
And Grace's slender iiugera bold
A braided fan from Mexico,
To make the broad flame* flare aud glow.
Alert, alive, they leap and run
Like fierce bright streann r* of the nun;
They shine ou Robert'* placid face.
And tint the pensive cheek of Grace,
And chase away the doubtful gloom
From ever} - comer of the room.
O pleasant thought! that far and near
Are gathering 'round each hearthstone dear
bright faces, happy *mile*, and eye*
Sweet with the summer'* tnemorie*!
O holy altar-fire* of home!
Tho' far and wtde the children roam.
Your charm for them shall still endure
With love so strong and peace so sure.

ANOTHER CHAPTER.
The Meredith escape and the circumstance* at
tending it were the subject of general comment ail
day yesterday.
The opinions expresred were various, bnt the be-
lief was well nigha.uanimous that blame attached
to somebody, and that it was the duty of the grand
jury to sift the matter to the bottom aud fix the
blame where it belonged.
Among many there was an expression of regret
that Mr. Bayue did not. in his card in yesterday’s
issue of the Telegraph, give the name of the gen
tleman who introduced him to Meredith in At
lanta. It was said that the publication of the gen
tleman's name would have gone far towards sub
stantiating Mr. Dayne'* statement.
In the City Court, yesterday morning, the matter
of disposing of the $250 placed in Deputy Sheriff
O'Pry's hands by Mr. Bayne, waa submitted to
Judge Harris. Tbe Judge directed Mr. O'Pry to
notify Mr. bayne that the money would be dis
tributed nmoug the officer* of the City Court as
provided for by the act creating that court. Mr.
O’Pry went to Mr. bayne's office aud served the no
tice. Mr. bayne, in reply, drew up a paper sub
stantially to this effect:
“I hereby notify yon to refund to me the two
hundred and fifty dollars which I placed in your
bauds in order to secure Meredith’s presence in luy
office to arrange a bond for him.”
This paper was directed to Mr. O’Pry, and was
signed by Mr bayne.
Mr. O’Pry itidorsed on the back of the paper a
statement certifying that it was the original of thu
notice which he received from Mr. bayne. He then
DELIVERED IT To Jl’lMiE HARRIS.
Judge Harris had the officers of the City Court
called before him, aud payiug no attention to Mr.
bayne’s notice to Mr. O Pry, distributed the money
among them.
As to the validity of the bond. Judge Harris held
that although the bond drawn up by Justice W. A.
Poo bad not been signed by anybody, yet that there
was a verbal bond agreed to by Mr. bayne. Ho
held, further, that the Supreme Court had decided
that in >ucb cases, a verbal bond was valid. There
fore, he decided that aa tho prisoner, Meredith, had
escaped, the bond was forfeited and the money
must be divided among the officers of the court.
On tho other hsnd it is asserted by several law-
f ers that if Mr. Bayne waa the bondsman, in wru
ng or verbally, the bond was Invalid, because the
law expressly forbids a lawyer to become surety
for a criminal, or one supposed to be a criminal.
The latter view, it is presumed, is the one taken
by Mr. Bayne.
It is understood that after the organization of the
grand Jury yesterday morning the pickpocket cases
wero the first considered. It is also understood
that the Jury will give the matter of Meredith’s es
cape a thorough investigation, and maka a special
S resentmeut of their action concerning it to the
unerior Court
If Mr. bayne contests Judge Harris's disposition
of tbe $250. and it is alleged that he will, and re
verses the Judge's decision, the officers will be com
pelled to refund the money.
Other facts connected with Meredith's escape
may yet be devolopcd.
