ter of foreign relations, Seuor Morrqpcula,
has advanced a communication under date
of 12th to Minister R-unero at Washington
giving a review of ail tho legal points in the
Cutting controversy. The «owmuni-
cation draws attention to the inexactitude
of some of Secretary Bayard’s statements,
due, no ^ doubt," it says, to unreliable in
formation given him by interested and
excited persons.
The prosecution of Cutting did not origi
nate with the judge, as stated by
Bayard, but was tho result
of the offended party’s complaint,
made in due form against Cutting who
was not only not refusod legal assistance,
but was provided with ooufitol, hs tuforiag
to employ a lawyer.
The communication enters at length into

at the State Department that there aie no
fresh development in the Cutting case and
that the attitude of this government has
not changed in any respect.
This case is the fruit of natural friction
or antagonism betweeu systems of govern
ment of two peoples who differ radically in
character »na customs. The portion we
have taken is based upon the as
sumption that all material facts
and legal features of the ense are
as they have teen set forth in tho corres
pondence and reports already made public;
but in the matter involving possible war
fare, it i* held to be incumbent upon us to
make sure that there is nothing of im
portance beyond official information already
in hand, and to this end the best efforts of
the department are turned.

cision will have to be made, whether the
differences found to exist shall be recon
ciliated through further effort of diplomacy
or by war; but in no event will this gov
ernment assent to the doctrine that an
