executive and treasury departments prior
to the passage of the act nnder considera
tion to treat appropriations payable ont of

appropriations, and not dependent on there
being a ampins in tbe treasury after other
appropriations have been provided for. No
rule is better settled than that, in case of
ambiguity ordonbt as to the construction of
a statute, the uniform and contemporaneous
ocnitruction of the executive department is
decisive. Tbe reason of this rule is appar
ent. it being an irresistible presumption
that if the Legislature was dissatisfied with
executive construction it wonld so declare.
It is very clear that it would not pass new
statutes identical in phraseology with
former laws which had received a definite
and uniform executive construction without
intending to approve that construction.

"Confirmatory of the views already pre
sented is the significant fact that in the
case of the new capitol tho Legislature of
1882 3, in making an appropriation for its
construction which it intended should be
paid only ont of surplus lands in the
Treasury, did not make it payable out of
‘any money not otherwise appropriated.’
That intention was expressed In plain
word a.
The act making tbe appropriation pro
vided in terms that It waa payable only out
of any ‘ampins' remaining in the treasury.
“That same Legislature pasaed sevend
appropriation acta in which the appropria
tions wore made payable from funds In the
treasury not otherwise appropriated. If
these words were supposed to be synony
mous with the word ‘surplus,’ why waa
the latter word uaed in the act making pro
vision for a new capitol? With this nota
ble instance of an appropriation payable
ont of anrplns funds only, fresh in the rec
ollection of the Legislature which
passed the |act to establish a school
of technology, it is diMoult to believe that
it would, iu ’ making an appropriation for
tbe latter, have departed from the express
ive phraseology used in relation to tbe
former, if the appropriations were intended
to be alike in character.
“Nor is it reasonable to anppoae that tbe
General Assembly, after appointing a com
mittee to visit sad inquire into the work
ings of similar institutions iu the Northern
Mates, (and after a pending a Urge part of
two sessions in iu consideration, wonld
have pasted the measure in anoh shape,
that whilst it authorized the Governer
to appoint immediately a commission to
select a site and accept donation, and make
contract, for the erection of buildings, etc.,
ueverthele.a made no available appropria
tion fur the consummation of tbe enter
prise. Such a construction of the act wonld
accrue the Legislature ot having consumed
mnch valuable time in performing tbe play
of 'Much Ado About Nothing.'
"It is an ancient and well-established
rale in the interpretation of iterates, that a
construction which leads to unreasonable
and absurd results is to be avoided. It seems
to me that to construe the act nnder
consideration as making^io available appro
priation, wonld be, in view of ita history
and design and of what it contemplates and
authorize., to attribute to the Legislature
conduct bordering very cloaely on tbe
absurd#
"From what has been stated, the conclu
sion la inevitable. The act, in my opinion,
makes an appropriation payable after the
the 1st day of January, 1887, ont of any
money then in the treasury which
baa not been appropriated or a*l
apart for some special object, aa, for
example, the school fond or money
aedicuieu to the pijrsent of the bonded
debt of the State. Ot course no warrant
on the Treasury should be urawn until the
condition specified tn the second proviso to
tho 12th section of the act is fully and sat-
