3y His Excellency, Joseph M, Terrell, Governor of
the State of Georgia, [xecutive Department, July
29th 7904,
\Whereas, the General Assembly, at its session in
1303, proposed an amendment to the Constitution of
this State, agget forth in an act, approved August I7th

sec. 1. be itenacted by the General Assembly’ of
( Georgiu, and it is hereby enacted by authority of the
same, Th .t from and after the passage of this Act, that
article 8, sect on 4 pragraph | of the Constitntion of
the State be ultered and amended by striking out the
word *‘upon the recommendation of two grand Juri s"’
which begin in the first line after the word *‘Countizs”’
l and er.d w the second line before ths word “‘and’’ and
substituting th- refor the words “militia di tricts,school
l districts’and by inserting the words ‘““mditia districts,
shool districts’’ in the seventh line afterword*County”’
andbefore the word‘‘or’’and further by striking out the
word *“two-thirds’’ whic.. begins in the seventh line
after the werd ““a’’ and ends in the eighth line before
the word ““voie’’, and subs ituting therefore the words
“two-thirds majority of those voting’’; so that saia
paragraph shail lead when amended, as follows, viz;
“Authority may be granted to counties, mali ia dis
nicts school districts and to municipal corporations,
upon the recommendat’on of the corgorate authority,
to establish and mantain public schools in their respec
tive limits by local taxation; but no such law shall take
effect until the same shall hav. been submiitel to a
vote of the qualified voters in cach Cousty, militia dis
trict, school district, or municipal corporation, and ap
proved by two-thirds majority of persous voting at
such election, and the General Assembly my prescribe
- who shall vote on such questions.”’ |
. Seciion 2 Be it further enacted, That it this
amendment shall be agreed to by two-thirds of the
members elected to each of the two Houses, the same
<hall be eutered on their Journals, wih the Ayes and
Nays taken thereon, and the Governor shall cause saN
amendment to be published in one or mo:e newspapers
in each congressional district for two months previous |
to the next general election, and the legal voters at the |
next gcnr,ra%clcction shall have written or printed on
(heir tickets ¢ Ratification’, or ““Against Ratification”’
s they may choose to vote, and if a majority of the
laectors qualified to vote for the (ieneral Assembly,vot
ing shall vote in favor of Ratification, then said amend
ment shall become a part of said” article 8, section 4,
paragraph 7 of the Constitution of this State, and the
Governor shall make proclamatio. thereof.
Now, therefore 1 Joseph M, ‘T'errell, Governor of
said State, do issue this my proclamation hereby dec ’
clairing that the toregoing proposed amendment to th
Constitution is submitted for ratificaticn or rejection to
the voters of the State, qualified to vote for members
of the General Assembly, at the general election to be
held on Wednesday, October sth 1304.

the next term of said cenit to be held in and for Lee

the plaintiff, Fanme Howell, against you for a total
