Dr. Lewis, the Superintendent of the
State Road, is no candidate for Governor,
but a faithful public officer, who dischar
ges the duties assigned him, with a fideli
ty and success that arc rare in these days,
and which entitle him to the gratitude of
the tax payers of Georgia, despite the
charges brought against him by small pol
iticians and hunters after office. The peo
ple, too, will see to it, that Ills manage
ment of the State Road will be endorsed
in the defeat of the Opposition.—Macon
State Preen.
The Voice of Kentucky on the Ques
tion of Congressional Protection.
The Democratic candidate for Governor
in Kentucky, who was elected by 10,000
majority, thus speaks in regard to the ter
ritorial question. Mr. Magoffin says :
That Congress has the power to pro
tect, while it cannot prohibit, slavery in
the territories; that the territorial legis
lature, as its agent, cannot exclude or a-
bnlish slavery, directly or indirectly, by
unfriendly legislation; that such legisla
tion is void, and would be declared uncon
stitutional by the federal courts ; that it
is the dtilv of the territorial legislature to
protect slave property, and property of
all kinds; that the rights of property of
all kinds arc under the protection of the
government, the constitution and the laws;
that the struggles and victories over other
parties have clearly shown that ours is the
onl}’ party capable of protecting our rights
or guarding them in the future; and if it
should be necessary, to pass laws to en
force the decrees of (he judiciary, or even
to call out troops, that it would he the du
ty of the government to do so.”
Judge Taney on Slavery.
In the case of the slave Amy, decided a
few days since, Chief Justice Taney lias
furnished a written decision, in which he
asserts the following great legal principles
touching the institution of slavery in the
United States:
1st, That slaves are recognized by the
Constitution of the United States in the
character of persons.
2d, That slaves are represented in Con
gress, as persons.
3d, That as persons, they are, in many
instances, at least subject to certain liabil
ities, and invested with the rights corres
ponding to those liabilities, in the same
way that other persons arc.
4th, That among these liabilities are
those which render them amenable to tri
al and punishment for crimes and misde
meanors ; and among these rights is the
right of legal protection against personal
injury.
5th, That the Constitution of the United
States also recognizes slaves as property.
6th, “As property, the rights of owners
are entitled to the protection of the law;”
i. c., the laws of the United States, enact
ed by Congress.
