Absent, Aldermen Harvey, poerdwger and Conper. The minutes of the last regular and u.ljonrned meetings were read and cou firmed. The appeal cases of Horace Cadone nail W. J. Williams were continued , an adjourned meeting to be held ,,t 8 o’clock r. m. on Thursday, the 4th iust. Head a communication from John Murray, asking Council to repair the ditch running through Old Town lot number 252, as he was losing 20^180 feet on account of the bank falling in, which was, on motion of Aid. Littlefield, received and referred the comrnittes on streets, drains and bridges. Read a communication from A. V. Wood and others, asking permission to put up along and across the streets the poles uecesssry to carry the wires of the telephone exchange, which was, on motion of Aid. Cook, received, and the permission granted to put up the poles, under the supervision of com mittee on streets, drains and bridges. To the Honorable Mayor and Council of th- City of Brunswick: The finance committee to whom was referred the communication of B. Burroughs and D R. Martin, asking Council to refund them the sum of $59 95, the amount of taxes paid the city on five-sixths of Old Town lot No. 115 by the estate of J. D. Watkins, beg leave to submit that they rind, upon investigation of the matter, that J. D. Watkins claimed to have tlm legal title to the said lot up to the time of bis death, and that be paid the taxes tbereon for a number of years, and only ceased paying be cause the taxes were also paid by oth er parties claiming the lot under the head right grant of Urbanns Dart, and because such payment would not avail tlie party paying anything when ever the tjuestion of title should come up iu a suit at law. Mr. D. R. Mar tin bought the claim of the party un der tlie head right, some years since, and Ims been, through bis agent., re- tlulling and paying the taxes thereon. After tiie death of Mr. Watkins, the administratrix ofhisestnte, Mrs. Wat kins. took possession of the property by tin-losing the same, under the nd- vh— of uer attorney, Mr. William Wil liam-, and being then in possession of tie- l-.t, she returned and paid through in i- at.toruey and agent, the tuxes for the wars 1880 and 1881, amounting >o $od >J5- Iu tho meantime Dr. Bnr- l oitgns had bought, one-half interest in tin- claim of D. R. Martin, nnd on looking over tho situation, bo thought it advisable and best to buy out the interest of the Watkins estate, which was done by paying Mrs. Watkins the sum of 8500 00 and the ainonnt paid by her for taxes, and this was indeed an exceedingly low price for tho prop erty, till things considered. Both par ties voluntarily returned tlie proper ty, mol both parties voluntarily paid the tuxes thereon. No compulsion, ■i ii. ( it.v..r, was used by the city in forc ing u i■■iuru of the prop, r.y, or tlie piu -.c-nt hi the taxes from either par ty. The tuxes having been volunta rily paid by one party, the city could tint and certainly would not have in.i n an effort to enforce the collec tion of the taxes from tue other par ty. The city cun out, us every one knows, legally eulorce the collection ot iui»ta upon properly but oue time, bat. d several claimants come forward an I nut only offer but insist upon paying tho taxes upon the same prop erty, eucb believing that be has the legal title to the property, the cit cannot legally refuse to receive tbe amount from either of the claimants; and having once received it from tbe party voluntarily paying it, no law in this State or country will compel tbe city to refund tbe amount. Again, if this amount be refunded, the prece dent would be a bad one, and would sui'ject the city, no doubt, to innu- inei able applications for a like relief from persons who bad voluntarily re turned und paid tbe taxes on proper ty which they believed belonged to them. . The committee uuder all tbe facts and circumstances of this case must report adversely to tbe refunding of tbe said $59 95. Respectfully submitted, Jesse Wilder, J. J. Sl-EARS, Jno. R. To the Honorable Mayor and Council of the City of Brunswick: The finance committee,to whom was ZZ o/nZh Zh - f referred the communication of A. A. of Health, with instructions to Taft, asking Ooundl to refund him report at an adjourned meeting to be tbe sum of $349 40, which sum he supposes was left in tbe bands of tbe City Treasurer from a sale of certain lots in the year 1868, beg leave to submit tbe following statement of faeta- in relation thereto: These lots were sold as the property ofthe’estate of E. H. Eldridge, of tbe State of Massachusetts. The lots had been re turned by an agent, of tbe estate for a number of years, and were returned by him in the year 1867, but tbe par ty managing the estate failed to fur nish the agent with the money to pay the taxes, and he was forced to let tho property go to sale. There was, at the time of sale, no redemption of property allowed under the charter of tbe city, but the party in charge of the estate made efforts to do so, bnt only succeeded in one instance. It was certainly known to the agent and the party iu charge of the estate that the amount realized, beyond tbe pay ment of taxes and costs, belonged to the estate, and the probability is in* deed very strong that such amount wns paid over to tbe estate. If it were not so paid, it certainly was not the neglect or fault of tbe city, bnt solely the ueglect or fault of tbe ageut or party in charge of tbe estate. An agent has returned nnd paid tbe taxes on the remaining property of the estate since snob sale, and it is not probable that tbe parties interest ed would have slept over their rights all these years. The petitioner, air. Taft, has recently purchased tbe prop erty then belonging to the estate, and it is hardly probable that he paid the estate anything for tbii supposed claim against the city. The commit tee are constrained, under these facts, to report adversely to refunding tbe said amount. Respectfully submitted, Jesse Wilder, J. J. Spears, Jno. R. Cook, Finance Com. Tiie finance committee, to whom wns referred tbe communication of tbe Marshal and policemen, asking Council to give them some assistance in the purchaso of their uniforms, beg leavo to state that they have taken tho matter into careful consideration, and must report adversely thereto. The Clerk and Treasurer aud Mar shal submitted thoir reports for tho months of January and February, ex amined and found correct by tbe fi- nauce committee, which were received and ordered to bo published and filed. The Harbor Master submitted his report of the arrival of vessels during tho month of April, 53 in number, which was received and ordered to bo placed on file. Tlie Clerk of Council, ns Secretary nf tin- Board of Health, reported that the Board had, at a meeting held Oil the day of April, recom mended that L. B. Davis, dr., be ap pointed watchman at tlie Quarantine Station; and that T. B. Goodbread be appointed Sanitary Inspector; but that the recommendation of T. B. Goodbread was, at a subsequent meeting held on the day of April, withdrawn. Also, that he was instructed by tbe Board to submit to Council the fol lowing resolution adopted by the Board at tbe meeting held on the day of April: Besotved, That the office ot city in spector and city scavenger be consoli dated, and that he shall be paid the sum of $100 per month, for tbe months of May, June, July, August, September and October, and whose duty it shall be to execute the orders and laws of tbe Board of Health; and who shall furnish all necessary means for the removal of excrement from privies nnd filth to tho place selected by tho Board of Health; and who shall give a bond of $500 for his faith ful performance of tbo duties imposed by the Board of Heath; and who shall be selected by the Board of Health; which was received and the matter referred to a committee con sisting of Aid. Cook, Littlefield, Har dy and Wilder, and the Chairman of held at 8 p. m., on Monday the 8th lost., an ordinance regulating and controlling the entire matter of tbe sanitation of tbe city. Council then proceeded to ballot for a 1 ” watohfnan or* 'keeper of tbe Quarantine Station, which resulted in tbe choice of Joseph Ring. By Aid. Wilder: Besotved, That tbe resolution adopted on the — day of — 1881, prohibiting the throwing off ot lumber, laths, shingles, staves, etc., on the eastern side of the rail road track on Bay street, between Gloucester and Mansfield streets, be enforced, and that tbe Marshal be in structed to have tbe same cleared off, and iustruct the railroad companies to keep tbe said space clear. The resolution, on being seconded, was nnanimonsly adopted. Tbe finance committee submitted bills amounting to $557.18, examined and approved, which were ordered paid. Council then called the appeal cases of W. J. Williams, which were, on motion of Aid. Spears, continued to tbe adjourned meeting to be held on the 8th inst.
