A singular suit baa .been fi,Ied' for
trial in the city court;. n The plaintiffs
are Rev. Qeo. W>: Baker and hia wife,
Mrs. Carriiue H. Baker. They hate
instituted suit against Mr. W. A
Huff, proprietor - of i the Markham
House, for ten thousand dollars as
damage for several bites from a rat
which she received while a guest of
the Markham in June last. In the
petition which is filed by Mr. .Baker,
lie sets up that he is a Baptist minis
ter iiud is engaged in the sale of
books of a religious character, and at
the time of the injure for wbiqh he
seeks damages, bis wife was sailing
a book called the “Baptist Encyclo
pedia," on every subscription , to
which she received from a-dollar and
a half to two dollars) in;:commission;
that her average monthly earnings
were t*o hundred dollars dp to the
time at wbicb she was bitten by the
rat, and that without that injury she
would have continued to eufa that
amount. The injury was received as
follows: In the month of June Mrs.
Baker, in the prosecution of ber workj
came to Atlanta and became a guest
of tbe Markham, of wbicb hotel Mr:
Huff is tbe proprietor. 8be> was as
signed to a room on the seoond floor,
which she described as one of the
highest priced rooms in ttwhouae.—
At night she retired after extinguish
ing the light, when suddenly she felt
the cover on tbe bed move. 8be
reached ont her left band, when her
arm was seized by a large rat, which,
sbe says, was so infuriated that before
she could take the baud away she was
bitten in eight places. The wounds
became badly swolen, and erysipelas
set in. The arm appeared ns if it
would mortify, and it seemed that
Mrs. Baker would lose it, and, per
haps lose her life. Mr. Baker recites
the trouble, expense and pain which
has been caused to himself and wife
and puts the damages at ten thousand
dollars, six hundred of which is set
down as actual loss, as wtiat would
have been bis wife’s earnings for three
months, and five hundred as an ex
pense f -r medical attention. Mr. Ba
ker says that Mr. Huff should have
kept his beds free from vermin. The
case is an unusual one, and tbe trial
