Officers Prohibited From Being Inter
ested in Any Municipal Contract, etc.
Section 40. Be it further enacted,
That no officer or employee elected or
appointed in said City shall be inter
ested, either individually as the mem
hei of a firm or as an officer or stock-
holder of any corporation in any con
tract, for the purchase or sale of eith
er personalty or realty by or from the
City or job fo^ work or material, or
the profits thereof, or service to he
furnished or i>erfonned for the City,
and mo such officer or employee shall
be. interested, directly or indirectly, in
any contract or job for work or ma
tt rials or the profits thereof or ser
vices to be furnished or performed for
any person, firm or corporation o'>erat
ing in ter urban railway, tram railroad,
street electric light or itower plant,
heating plaut, telegraph line, tele
phone exchange, or other public util
ity within the territory of said city.
Xo such officer or employee shall re-
ceive any commission or rebate or
ether personal benefit from any pur
chase of supplies, machinery, equip
ment, or other things used by the City.
Xo such officer or employee shall ac
cept or receive, directly or indirectly,
from any person, firm or corporation,
operating within the Territorial limits
of said City, any interurbau railway,
steam railroad, street railway, electric
light or power plant, heating plant,
telegraph line or telephone exchange
or other business using jjg operating
under a public franchise, any frank,
free pass, free ticket or free set
vice, or accept, or receive, direr-f
--l’y or indirectly from any such
person, firm or corporation any
other service ii)>on terms more
favorable than is granted to the public
generally. Any violation of the pro
visions of this section shall be a mis
demeanor and any such contract or
agreement shall be void.
Such prohibition of free transporta-

Recorder and His Powers.
Section 41. Be it further enacted.
That the Board of Aldermen shall at
the first regular meeting after they
are elected and qualified in January,
li‘lß, and every two years thereafter,
elect a Recorder for the City, whose
qualification shall be the same as that
ol members of the Board of Aldermen. '

and qualified. He shall have authority :
to administer oaths, and shall be
judge ‘ Police Court" in and for said i
City for the trial and punishment of!
all offenders against the law.-, and or
dinances of the City. He shall hold
police court as often as may be nece -
sary for the purpose, and shall have
power to preserve order, eoni)>el the
attendance of witnesses, compel the
production of material Ixrok-, papers
or documents, to he used as evidence
and punish by fine not exceeding
>lo,oo or confinement in jail where
city prisoners are kept not exceeding
24 hours for contempt committed in
his presence in court. He shall have
power to punish any person convicted
of violating any penal ordinance of the
city, or of any penal section of the
charter, not made a state offense, by
fine not exceeding SIOO.OO or by im
prisonment in the jail where city pris
oners are kept not exceeding 30 days,
or to work on the streets in the city
chaingang not exceeding 30 days, or
the first and either the jail or the
chaingang sentence, or he may impose
the fine with an alternative of either
the jail or the chaingang sentence.
All fines imposed under this section
may be collected by execution issued
by the clerk.
Recorder May Commit For State
Offense.
Section 42. Be it further enacted,
That the Recorder, upon investigation
of any offense charged against any
prisoner brought before him when
presiding in said Police Court and it
shall appear that the prisoner has com
mitted an offense against any criminal
law of the State, shall have the same
power and duties of commitment to
jail or to bond, as are now' conferred
by the law of the State upon Justices
of the Peace.
Police Court and Officers, Preserved.
I Section 43. Be it further enacted.
, That the Police Court as it now ex
j if-ts, together with all the powers and
! duties conferred upon the Mayor as
i the Judge or presiding officer thereof,
all provisions of law for appeal or cer
tiorari and all other rights now exist-'
ing for the benefit of persons convict
ed of offense against the laws and or
dinances of the City, or charged there
with or arrested therefor, are pre
served.
Laws and Powers Preserved.
Section 44. Be it further enacted,
That except as otherwise provided in
this act, all laws existing, and all pow
ers vested in the Board of Commis
sioners. shall be preserved. _
Salaried Officers.
Section 45. Be it further enacted,
That the salaried officers of the City
and the salaries thereof shall he as
follows: The Recorder, who shall re
ceive a salary of $300.00, payable quar- j
terly; (2) A Clerk and Ex-officio Trvas- j
titer, who shall receive $120.00 per <
month, payable at the end of each !

Officers, How Selected.
Section 46. Be it further enac.ed
That the Board of Aldermen shall have
the same power and authority to se
lect and appoint officers and em
ployees, except as otherwise provided,
as well as the ftower io remove the
same, now vested in the Beard of Com
missioners. The duties of the City
Clerk and other officers provided for
in this act, and as otherwise herein
provided, shall be as they now exist,
except as to the City Manager, whose
duties are hereinafter prescribed.
They may provide for a Deputy Clerk
to act in the absence of the Clerk.
City Manager.
Section 47. Be it further enacted,
That at the first regular meeting of
the Board cf Aldermen after they are
qualified, or if for good cause it be im
practicable, at that time, as soon there
after as possible, the Beard shall ap
point a suitable skilled irerson of good
mbral character, having had training
or exjierience fitting him for the du
ties of the office as “City Manager”
who may be a non-resident of the City
and of the State of Geogria
Oath of City Manager.
Section 48. Re it further enacted.
That before entering on his duties the
City Manager shall take and subscribe
an oath to faithfully discharge all the
duties of his office and to scrupulously
observe all laws and ordinances of the
City.
Bond of City Manager.
Section 49. Re it further enacted,

with solvent sureties suable in Bartow
C unty, to be approved by the Board
of Aldermen in the sum of $3,000.00.

Term of Office of City Manager.
Section 50. Be it further enacted,
That the term cf office of the City
Manager shall be far and during the
term of the Board of Aldermen during
which he is appointed, subject how
ever. to be removed by the Board af
tei 30 days written notice to him stat
ing the ground of removal. Xr> such
removal shall be made for frivolous or
|K)litical reasons.
Duties of City Manager.
Section 51. Be it further enacted,
That the City Manager shall be the
administrative head of the City gov
ernment, except as otherwise provid
ed. He shall be subject to inquiry and
investigation by the Board of Alder
men or any member thereof concern
ing City affairs and shall give full and
complete Information upon all mat
ters relating to the suject of inquiry.

nomical operation and maintenance of

writing, except current supplies, and
all negotiations for the purchase of
equipment, machinery, engines, stock,
repairs, and all other article - except
for current use shall be by written
correspondence, except such oral neg
otiation's as are had In the presence of
both the City Manager and lhe Board
of Aldermen, and for this purpose, a
n eefing of the Board may be called
by the. Manager or any member of the
Board at any time upon four hours
notice to the others. This provision
! shall not bar visits and inspection of
| an\ equipment or other thing coming,
i w ithin this section to be purchased.
Duty of City Manager to Attend Board
Meetings.
Section 52. Be it further enacted.
That it shall be the right and duty <ji
the City Manager to attend the meet
ings of the Board of Aldermen, except
at such times as his official acts or
his relation to the City in any way
may be under discussion and fronsidvr
ation. The Board or any member sliull
have the riglu to require his appear
ance at any meeting, when it iv de
sired to obtain information from him
or advise with him concerning City
affairs. He shall not have the "manage
ment of the City schools or property,
except as to the tights, water supply,
sewerage, and plumbing and such ofh
ei matters as may be specially direct
by the Board of Aldermen.
He shall not have control or man
agement of the City offices, except as
tr keeping the building in Its proper
repair and as specially directed by the
Board, but he shall have free access
| thereto, and to the books and minutes
at all time, during office hours. and
have his office lu the City Hall

to him by the Board.

should become vacant at any time for
