Section 33. Be it further enacted, lhat the Board of Aldermen shall meet and organize on the first Wed nesday in January, next after their election, and shall hold regular meet ing? once a week, the time thereof to he as now provided until changed by ordinance. They may hold special meetings from time to time, upon cal! of the Mayor or the two Aldermen, provided twelve hours’ notice is given to all members, or is waived, which in. either case shall be shown on the minutes, and meetings may be ad journed io a later day in the same week, and all meetings shall be held at the City Hall. Two members shall constitute a quorum and all powers cf government except as otherwise ex pressly provided shall lodge in the Board as an entity and not in apy one or more of the individual members The Board may adopt its own ndes governing its proceedings .(but the rules now in force fer governing tin proceedings of the Board of Com in'. - sioners shall remain*of force until changed by resolution.) Section 34. Be it further enacted, That every ordinance or resolution ap propriating money for any purpose in excess of $500.00, or providing for the extension or improvement of any street or sewer likely to cost exceed ing $500.00 or the making or confirm ing of any contract, or the granting of any franchise for the use, by any per son or corporation, of the streets or other public property or utilities of the City, or the granting of any fran chise, or privilege, or contract to any person or corporation to supply to the City *or its inhabitants electricity, water, gas, or other like privilege, or providing for the purchase of any property, real or personal, equipment 01 fixtures; (except in cases of- emer gency) costing more than $500.00, shall be passed and become effective only in the following manner, to-wit: All such ordinances shall be introduc ed and acted upon at a regular meet ing of the Board, must be placed upon fhe minutes together with the votes, for and against, showing how each member of the Board voted, a copy of the ordinance shall be posted at some conspicuous place frequented by the public in the City Hall and shall, if otherwise valid, become effective after remaining of record seven days, ex cept in cases where a ]>etition is filed as hereinafter provided for a referen dum. Provided, That the provisions of this section shall not apply to resolutions or ordinances providing for bond elec tions, or the submission of any propo sition or measure to the vote of the people and shall not apply to ordin ances for the raising or appropriation of funds for any work, purchase, im provement, or other purpose, which has been made or brought about in pursuance of an ordinance of resolu tion previously passed therefor, in compliance with the requirements of this section, and shall not apply to any resolution or ordinance adopted for the carrying out of details or put ting into effect of any plans, policies, oi improvements provided for in a previous resolution or ordinance pass ed in accordance with this section. Petition for Referendum. Section 35. Be it further enacted. That if within Seven days from the recording and posting of any ordin ance or resolution of the character contemplated in section 34 a petition addressed to the Board of Aldermen, he filed with them or with the Clerk, signed by 25 per cent of the citizens registered to vote at the last general election of officers, requesting a refer endum of the ordinance or resolution, the Clerk shall forthwith notify the election managers who shall call an election to be held not later than 20 days thereafter at which the resolu tion or ordinance shall be voted upon. The ballots shall contain a copy of the measure to be voted upon, pre ceded by the words, “For” and “Against.” Those voting for the meas ure shall erase the word. “Against* - and those voting against it shall erase the word, ‘‘For.” If the majority of those registered to vote in the refer endum election vote against the reso lution or ordinance, it shall be defeat ed; otherwise it shall beepme effec tive. It shall be the duty of the election managers or if they fail, the Clerk, to have published at least once In a news paper published in the City the day und purpose of the election together with a copy of the resolution or ordin ance to be voted upon. Provided. That no election shall he held under this section, if prior to the date therof, the Board of Aldermen reconsider and iei>eal the ordinance or resolution in question. Initiative, How Exercises. Section 36. Be it further enacted. That it shall be the right of any citi zen of the City to submit to the Board of Aldermen in proper form, for pas sage, any ordinance or resolution af fecting the public interests of the City for enactment, and if the same be signed or approved in writing hv 25 pef cepj of those registered to vote at THE BARTOW TRIBUNE-THE CARTERSVILLE NEWS. SEPT 6, 1917 the last preceding general election for officers, it shall Ih> the duty of the Board to pass upon such ordinance or resolution not later than the second regular meeting thereafter, and if it fail of passage, the petition shall be transmitted by the Clerk to the elec tion managers within two days there after, and it shall be the duty of the managers to call an election not later than 20 days after receipt of the peti tion, under the same terms and regula tions as prescribed in section 35. if the majority of these registered to vote in said election, votes for the measure, it shall be the duty of the Board of Aldermen to pass the same al its next regular meeting after the election. Recall of Officers. Section. 37. Be it further enacted. That any one or more members of the Board of Aldermen may be removed from office in the following manner: A petition shall be filed with the elec tion managers containing the signa tures of not less than 25 pet cent of the whole number of those registerel to vote at the general election for of ficers next preceding, calling for an election for the recall of the member or "members of the Board therein named. All signatures must be per sonal or by mark, and witnessed, and the petition shall lie accompanied with an affidavit by ome signer who knows the facts. Tent the signatures are all genuine and those made bv mark were placed there at the request and in ibp •presence of such signor, and shall contain a general sta f ement ■ f the general grounds tmon which the recall is sought, the truth o? -whi -h shall be supported by the affidavit, upon information and belief, of one or more of the sig-ers, attache I to the petition. Within five day - after the j filing cf nob petition, excluding Sun : days, the election managers shall com pare the names appearing on the peti tion with the said registration book to determine if the petition contains the ! requisite ?“ per cent of such register- j ed names If it be found that the peti- j tion dee no 1 contain the requisite j number of such names It shall be re- j turned within seven days, Sundays ex- i cepted, to the person or persons from ! v. hotn received with a written state- ! meet of the number of names lacking, within five days from its return, Sun days excepted, the required number of additional'names may be secured, and the petition re-presented, together with (he same affidavit prescribed for j the original petition as to the signa- i t ures. If after again comparing the peti tion with the added names with the registration book, it be found to con tain trie requisite 25 per cent of those registered, the election managers, within 20 days from the last receipt of the petition shall hold an election to determine whether or not the member or members of the Board in question shall lie recalled. If, after comparing the petition with the added names, asi above stipulated, with the registration hook, it he found that it still lacks the required number of registered names, it shall be return ed to the person from who received with a written statement of the fact, v'ith the date of the return written thereon, and no election shall he held; and in this event, and in the event an election is had failing to result in the recall of the member or members of the Board in question, no like petition shall he received for the recall of any member of the hoard within four months from the date of the election in the one case, and the last return of the petition by the managers in the other, and in no case shall a petition be filed for the recall of any member of the Board of Aldermen, who shall not have been in service upon his or their present term of office for four months. The election managers -shall as soon as> practicable after the date of the election is determined upon, cause to be published in a newspaper published in the City, the time and purpose of the election, with the name of the member or members sought to be recalled and the ground upon which the recall is sought, and shall have the names of all such members printed on the ballot, each name being preceded with, “For the recall of” and “Against the recall of" and those voting for the recall of any member shall erase the word, “Against” and those voting against such recall shall erase the word, “For.” If the majority of there registered for the recall election, vote for the recall of any member or mem bers of the Board, he or they shall vacate office as soon as his or - their successor or successors are elected and qualified. Recall Goes Into Effect, When? Section 38. Be it further enacted, That no ordinance or resolution or act ot the Board of Aldermen, except the ordinary current affairs of the City, passed by the Board during the en eumber.cy of a member or members after being recalled as in the next preceding section provided, shall be binding upon the Board as constituted after the successor or successors of the recalled member or members are qualified, unless such resolution or or dinance is enacted by a majority vote of the Board, exclusive of anv recalled member, provided the Board as con stituted after the recall goes into ef fect repeal the same within ten daj s after the qualification of such succes sor or successors of the recalled mem ber or members. Election to Fill Vacancies Caused by Recall. Section 39. Be It further enacted, That upon the recall of any member or members of the Board of Aldei men the election managers shall hold_ an election as provided in section 2i 10 elect his or their successor or succes- Ssors. Any qualified person complying with this section may become a can didate .for the office and the candidate receiving the highest number of votes, in case only oae such member is to be elected, or the two receiving the highest number of votes, in case two are to be elected, or the three receiv ing the highest number of votes m case three are to be elected, shall be declared elected.
