The case of the Jeffersonian Pub
lishing Company, seeking to enjoin
the postmaster at Thompson and to
compel him to receive and forward
through the malls The Weekly Jef.
fersonlan, will not he appealed to the
higher courts.
Announcement to this effect was
made In a statement given out by J.
Gordon Jones, attorney for The Jef-
ersonlan Publishing Company and per
sonal attorney for Thomas E. Watson.
Almost simultaneously, announcement
was made In the second Issue of The
Thomson Guard, purchased by Watson
after the suppression ot The Jeffer
sonian, that this paper also cease pub
lication with this issue.
The Guard, several days prior to
publication ot its second issue by Mr.
Watson, had been officially cited by
the Postmaster General to show cause
why It should not bo barred from the
mails. The paper, in declaring Its
suspension, takes the position that It
Is "bowing to the Inevitable."
In his statement. Mr. Jones declares
that It Is not and never was the Inten
tion of M. Watson to Interfere with
or In any way obstruct the policies of
the Government. Mr. Jones' state
ment follows:
The case brought for The Jef
fersonian Publishing Company, to
enjoin the postmaster at Thomson
to compel h*m to receive and for
ward through the maalls The
Weekly Jeffersonian, which was
decided adversely to the plaintiff
by Judge Emory Speer, August 29,
will not be appealed to the higher
courts.

conclusion. The Postmaster Gen

Watson “Bows to Inevitable’’ And
Will Cease to Publish Magazines
Statement is Issued By His Attorney—Says it Was Never In
tention to Embarrass the Government
mind in that case before any no
tice was given the publishers.
We could go through the Su
preme Court with the case, and
win, but while the case is pend
ing the paper could not be sent to
its many thousands of bona flde
subscribers. Therefore, the whole
scheme to bar it from the mails
would be effective, and that it the
end sought by the Postofflce De
partment at Washington.
We gracefully bow and submit
to the authority, both of Post
master General Burleson and the
court's order, and suspend for tho
time any further proceedings to
reinstate the paper and to reverse
the lower court in its decree, ren
dered on the interlocutory hear
ing.
It is not and never was the
purpose of Thomas E. Watson to
interfere with or in any way to
obstruct the policies of the Gov
ernment. Mr. Watson, through
The Jeffersonian, took the posi
tion that if the conscript act or
the espionage act was unconstitu
tional, the question should be de
cided by the courts of the land.
He never advised or counseled op
position to any of the laws of the
Government. Mr. Watson has kept
within the constitutional rights,
going no further than asking for
a test cae to settle the const?
tutlonality of certain laws.
The Jeffersonian being denied
the second-class mailing privi
leges destroys It, causes thou
sands of dollars of damage. How
ever, there will be no appeal of
the case and so far as the case
concerns the publication of The
Jeffersonian It Is closed.
