TOBACCO TAX INVESTIGATION
SHOWS NO ILLEGALITY.

troller-General yesterday showed that
there had bocn no illegal collection of
$00,000 of tobncco taxea, of which a re
fund had been dcmnndnd by merchanta
vvlm had paid them to special agents ap
pointed by tho Governor. Tho back taxes
paid by doalers in tobacco who wore
nftorwords ontitled to a refund, under n
ruling made by the Comptroller-General
subsequent to their collection, and molli
fying a ruling formerly mndo by the
Governor on the advice of the Attorney-
General, amounts to just $8,l2G.04, ac
cording to figures compiled in the Ex
ecutive Department.
A portion of this bus already been re
funded, nnd tho balance will bo refunded
just ns soon ns the necessary investiga
tions linvo been mndo by the Tax Col
lectors of tho various counties to ascertain
whether it should bo returned. Not only
is the tnonoy paid to the Btato being re
funded, but it is understood that or-
iijngctiientH are boing made by tho Gov
ernor with tho special agents for a ro-
fund of tho amounts retained by them os
commissions.
The complication about these tuxes

ture levied a tax of $2fi each on dealers in
cigarettes, cigarette tobacco, and "ignr-
etto papers. When the Governor ap
pointed special tax agents to ferret out
unpaid back taxes nnd collect them, it
developed Hint a large number of dealers
in cigarette tobncco hud not been paying
the tax for years.
Tho Attorney-Ocneral held that dealers
in tobacco that was labeled for cigarettes
nnd pipes wore liable to the tax. At a
conference held In the Governor’s office,
attended by tho Governor, the Comptroller-
General, the State Tax Commissioner and
the eight special tax ngents, a written
opinion from the Attorney-General was
submitted, and tho tux agents were ac
cordingly instructed to go out and col
lect the tax. ✓
Later the question was raised by tho
Comptroller-General that tho Legislature
did not intend to levy a tax on all fine-
cut tobncco, but only on tobacco smoked
in cignretto form, and on cigarette pa-

chants who would swenr that they had
destroyed all cigarotte papem furnished
with smoking tobncco, had neither sold
nor given them awny, nnd had not dealt
in cigarettes during tho years from 1910
to 1918, inclusive
