Nine Points of the Law.
It has been said that success in
litigation requires a good deal of pa
tience, a good deal of money, a good
cause, a good lawyer, a good counsel,
good witnesses, a good jury, a good
judge, and, Inst but not lenst, good
luck. But the saying is really a .part
of the proverb which says that "pos
session Is nine points ’ of the law,"
and tbnt anybody Is welcome to the
tenth If they can get anything out

The following letter was received by C. J. Owens, Tax Collec
tor, in reply to a letter asking for an extension of time in paying taxes:
COMPTROLLER-GENERAL’S OFFICE
ATLANTA, GEORGIA
Atlanta, Ga., Dec..11 1920
Mr. C. J. Owens, Tax Collector,
Coweta County,
Newnan, Georgia.
Dear Sir:-
I am in receipt of yours of the 10th inet.
I recognize fully the distressed condition prevailing
throughout the State of Georgia. The Comptroller-General is
given no authority to extend the time of tax collectors for
collecting State taxes. The law gives the collector no author!--
ty to extend the time for collecting taxes. The State hfcB to
meet its appropriations, and is dependent upon the prompt col
lection of taxes with which Lo meet the appropriations made by
the General Assembly for the fiscal year.
The tax collectors are required to issue executions on all
delinquents on the 20th day of December, and there is no discre
tion conferred upon me or the collector to extend this time. It
would be very questionable whether a fi. fa. iBsued after the
20th of December could be legally enforced. You are, therefore,
instructed to issue fi. fas. against all delinquents on the
20th of December, aB the law requires.
Yours very truly,
(Signed) WM. A. WRIGHT,
Comptroller-General.
