Mrs. Clarence Hix, nee Miss Emily
Bayne died at her father’s home,
one mile south of here last V|cd
nesday following an operation. She
is survived by her father, four sis
ters, and two brothers. Funeral and
interment were in Pineville ceme
tery Thursday. Rev J W Ham con
duetd the services.

door of said county within the legal
hours of sale, on the 20th day of De
cember, 1921, to the highest and
best bidder for cash, the following
described real estate to wit:
All that tract or parcel of land
situated in the 10th District and 4th*
Section of Walker county, Georgia,
described as follows: All that part
southwest corner of said lot No. 271,
which commences at the original
southwest corner of said lot No. 171,
and running east with the original
line of said land lot to a certain
rock, thence southeast to a certain
pine tree on land lot Noj 306, thence
east to the comer of the fence,
thence near east, within live feet
of the land or line known as E. N.
Thompson line to a certain rock
comer at the wood iot fence, thence
near -north with the fence to the
original line, thence east with llitf
original line to a rock corner at the
cross fence, with a twenty foot road
on original line to Chattanooga Val
ley Road, thence near north with
the said fence to what is known as
G. W. Moore’s line, thence near
west to a forked pine tree outside of
the fence, thence in line with what
is known as G. W. Moore’s line di
rect to the top of the ridge, thence
south to the top of the said ridge
to the original line, thence with the
original line to point of beginning,
containing forty acres more or less.
(Reserving, however, all the iron ore
rights heretofore sold to E. W.
Marsh in said land.)
The aforesaid real estate is to be
sold under the terms and conditions
of a deed executd in th tlth day of
August, 1919, by Katherine Roush
to Mary Mullins conveying the a
fore.said real estate to secure the
payment of four notes for the prin
cipal sum of $337.50 each, due res
pectively, one, two, three and four
years from dale, bearing interest
from date at the rate of sov#n per
cent per annum, which said deed
contains a provision for the sale
of said real estate upon default in
the payment of any of the aforesaid
notes. There has been a default in
the payment of the note due Aug.
Hth, 1921, and the said Mary Mullins
has elected to declare all of the re
maining notes due and colleetible.
to wit: Three notes for the sum of
$337.50 each, due respectively on
August tt, 1921. Aug. 11th., 1922 and
August, tlth 1923. with interest
thereon from date at the rate of sev
en per cent per annum.
The undersigned Mary Mullins,
will execute a deed to the purchas
er of the aforesaid real estate, and
the proceeds from said sale will be
applied, in accordance with the con
ditions of the riegd from Katherine
lhuuh to Mary Mullins, to the pay
ment of said notes, with the interest
the.eon, and the expense of the pro
ceeding, including auctioneer’s fee
of ten per cent and the attorney’s
fees incurred herein, and the re
mainder, if any, to said Katherine
Rousch. .
