SANITARY ORDINANCE
CITY OF LAFAYETTE, GA.
An Ordinance providing for the dis
pirsal of human excreta; defining the
terms; declaring unsanitary privies a
nuisance; providing for the connec
tion of all homos with the city sewer
and water mains, where sewers are
within proximity of the premises; pro
viding for the installation of sanitary
privies in the unsewercri area; provid
ing for the use, construction and
maintenance of same; fixing the pen
alty for the violation of the provisions
of this ordinance and the repealing of
other ordinances or parts of ordi
nances in conflict hereto and declar
ing an emergency.
Be it omdained by the mayor and
council of the city of LaFayette,
Walker County, Georgia, and it is
hereby ordained by authority of same:
Article One
Providing for sanitary methods for
disposing of human excreta enjoined
upon occupants and owners of prem
ises.
Section 1. Every residence and
building in which human beings re
side. are employed or congregate,
shall lie required to connect with city
sewer and city water mains, where
the buildings are within proximity to
city sewer and water mains or later
als. All other buildings shall be re
quired to have a sanitary method for
the disposal of human excreta, to-wit:
Either a sanitary water closet, a sani
tary privy or other method approved
by the Board of Health.
Section 2. It shall be unlawful to 1
dispose of any human excreta within |
the corporate limits of said city, ex
cept in a sanitary water closet, a sani
tary privy or other sanitary method
approved by the Board of Health.
Section 3. It shall be unlawful for
any person, firm or corporation, own
ing, leasing, or renting property with
in the limits of said city to permit
tihe disposal of any human excreta on
any property owned, leased or rent
ed by such person, persons, firm or
corporation, or the agent of any such,
except in a sanitary water closet, or S
sanitary pi i vy, and it shall be unlaw-;
ful to permit the disposal of any ma
terials in a sanitary privy, other than
human exeneba, paper or disinfectant.
Section 4. Any building, as defined
in Section 1, of this article, on a street
having sewer and water main, shall
be required to connect therewith a
sanitary water closet.
Section 5. No dirt pit shall be built

limits, of said city except umler the
approval of mayor and council and ex

Section G. Septic tanks may be con
structed in the unsewored areas of
said city, subject to the approval of
the mayor and council.
Article Two
Proriding for operation of this or
dinance:
Section 1. The mayor and council of
said city shall require that the ex
pense of the sewer connections be
borne by the property owners.
Section 2. The cost of installing a
sanitary privy for the disposal of hu
man excreta shall be borne by the
owner of the property upon which the
sanitary privy is to bo located.
Article Three
Declaring open privies to be a nui
sance, and proriding for the abate- j
ment of such nuisances forthwith. ;
Section 1. All privies within the,
corporate limits of said city, not con-1
struct**! and maintained in conform-!
ity with the provisions of this owii-j
nance, shall lie, and arv hereby dcclar- I
ed a nuisance, dangerous to the public
health of the inhabitants, of said city,
and sh;dl be condemned ami forthwith
abated, in accordance with law, or the I
ordinances of said city.
Section 2. The city shall haw the
right to cause to he made such alter
ation to such privies as are nuisances
as to render them sanitary. The entire
cost of such work shall be charged a- 1

Article Four
Defining terms used in this ordi
nance:
! Section 1. Human Excreta—The
1 term “human excreta” as used in this"
crdinewee, shall be construed to mean
jt he bowel and kidney discharges of
'human being’s.
Section 2 The Dirt Pit: The term
“dirt' pit” as used in this ordinance,
shall be construed to mean an under
' i ground cavity without water tight
| walls, in which is placed human ex
} ‘ creta.
j Section 3. Septic Tank: The term
, “.-ept:c tank”, as used in this ordi-
I dunce, hall be construed to mean an
1 underground cavity with water tight
• walls into which flows the effluent of
a sanitary water closet, and from
which the effluent does not come to
; the surface of the ground.
• Section 4. Sanitary Closets: The
term “sanitary water closets,” as used
in this ordinance, shall be construed to
mean any flush type toilet which is
1 properly connected to a city sewer or
to a septic tank of approved construc
tion.
Section 5 Sanitary Privy: The
term “sanitary privy,” as used in this
I ordinance, shall be construed to mean
j a privy which is so constructed as to
j conform to the following specifica
tion's: To be made of concrete, four
| feet long- four feet deep; four feet
wide, with baffle walls and three com
-1 partnu-nts with six inch effluent tile
pipe buried two feet below ground lev
i el, or other type of construction ap
| proved by the Board of Health. Pri
i vies shall be installed under the Coun
t ty Heard ctf Health, and shall be prep
[ erly cared for and subject, at any
I time to inspection by health authori
, ties. Sanitary privy shall also include
; seat pit as defined in Sec. 5, Article 1.
The privy box shall be ventilated by
a £|ue not less than six inches square,
which shall extend from the top of the
privy box to twelve inches above the
j roof of the privy. The top of the flue
shall be covered to prevent the en
i trance of rain, but to allow free
egress of air.
Article Five
Penalties.
Section -. Any person or persons,
firm or corporation ,or agent of any
person or persons, firm or corporation,
who neglects, fails or refuses to com
ply with any of the provisions of this
ordinance, shall be deemed guilty of
a misdemeanor, and when convicted,
shall be fined a sum not less than five
dollars, nor more than fifty dollars,
, imprisoned in the city jail for not
, less than one day or more than thirty
j days, confined at work on the streets
’ of said city for not less than one day
: nor mare than thirty days, or any
' part or all of the aforesaid penalties,
■ in the discretion of the mayor, or may
! or and council, and each time such
| person or persons, firm or corporation,
j or agent thereof, neglects or refuses
i to comply with any of the provisions
I of this ordinance shall be deemed a
separate offense and punished as here
in provided. . ..
Article Six
Repealing Clause:
Section 1. All ordinances or parts
I of ordinances in conflict herewith are
i hereby repealed.
Article Seven
An emergency declared,
j Section 1. For the preservation of
the public peaice, health, and safety,
an emergency is hereby declared to
exist, for the reason that the exist
ence of unsanitary privies within the
corporate limits of said city are dan
gerous to the public health, of the in
habitants thereof, and for this reason
it is ordered that this ordinance take
effect from and after its passage, pub-

Article Eight
Providing when cases shall be made
for non-compliance.
Section 1. Be it further ordained,
that all parties residing within the
corporate limits of said city shall
have until the 15th day of June, 1924
to comply with the foregoing ordi
nance before any cases shall be made
against them fpr a failure to comply
with the same.
