Be It resolved by the Board ot
Health of Clayton County, Georgia,
that the rules relating to sanitation
of premises adopted by said Board
be amended as follows:
A regulation defining “nuisance”,
“health officer”, "person”, etc;
prohibiting nuisance; and providing
for the enforcement of this regula
tion.
The Board of Health of Clayton
County, Georgia, ordains:
Section 1. DEFINITIONS
The following definitions shall ap
ply in the interpretation and en
forcement of this regulation:
A. Nuisance. —■ The word “Nuis
ance” shall mean whatever is dang
erous or detrimental to human life

tends to render soil, air, water or
food impure or unwholesome.
B. Health Officer — The term
"health officer" shall mean the
Commissioner of Health of Clayton
County, Georgia, or his authorized
representative.
C. Person — The word "person"
shall mean person, firm, corporation
society, association, or municipality
Section 2. SPECIFIC NUISANCES
The following are specifically de
clared to be nuisances:
A. Toilets, other sanitary facili
ties, plumbing or sewers in bad re
pair.
B. Conditions conducive to the
breeding of flies, mosquitoes, or
other insects.
C. Pollution of the air by gases,
vapors, fumes, mists, dusts, or
smoke in quantities sufficient to be
disagreeable, discomforting, or de
trimental to health or well being.
D. Trash, garbage, reluse, or any
foul,, decaying, or putrescent ma
terial kept or used in such a man
ner or place as to be or become of
fensive, objectionable or detrimental
to health or well being.
E. Keeping of horses, mules, asses
cows, sheep, goats, hogs, dogs, rab
bits, guinea pigs, hamsters, chick
ens, turkeys, geese, ducks, pigeons
or similar fowl or animals except
under the following conditions:
(1) Any housing or enclosures
used by such animals or fowl shall
be well drained, free from accumu
lations of animal excrement and
objectionable odors, and otherwise
clean and sanitary. Animal ecre
inent shal be disposed of in a man
ner approved by the health officer.
(2) Such animals or fowl shall be
kept at the following minimum dis
tances from any occupied building
except the dwelling unit of the own
er:
Horses, mules, asses or cows, 75
feet.
Sheep or goats, 75 feet.
Hogs, 900 feet
Dogs, 25 feet
Rabbits, guinea pigs, or hamsters,
25 feet.
Chickens, turkeys, geese, ducks,
pigeons or similar fowl 25 feet.
(3) Except in areas designated ag
ricultural by the zoning authority
having jurisdiction, each such ani
mal or fowl shall be provided with
the following average minimum
floor or ground area in the enclos
ure or housing in which it is kept:
Horses, mules, asses or cows, 200
square feet.
Sheep or goats, 150 square feet.
Hogs, 150 square feet.
Dogs, 100 square feet.
Rabbits, guinea, pigs or hamsters, 4
square feet.
Chickens, turkeys, geese, ducks, pig
eons or similar fowl. 4 square feet.
(.4) Except in areas designated ag

pigeons or similar fowl, 75.
(5) All such animals or fowl, ex
cept dogs in areas where confine
ment of dogs under the rabies con
trol regulations does not apply,
shall be kept in adequate enclosures
or tethered.
(6) Diseased animals or fowl which
might infect healthy animals or
cause a menace to the public health
shall be isolated or destroyed as the
health officer deems necessary.
(7) In the case of bona fide lic
ensed pet shops, veterinary hospit
als, stockyards, poultry houses, and
similar commercial establishments,
the health officer may modify these
requirements where undue hard
ship would result from theih strict
enforcement.
Section 3. Nuisance Prohibited
No person shall create, maintain,
support, aid or continue a nuisance.
Section 4. Penalties
Any person who violates any pro
vision of this regulation shall be
guilty of a misdemeanor. Each and
every violation of the provisions of
this regulation shall constitute a
separate offense.
Section 5. Repeal and Date of ..
Effect.
All regulations or parts of regu
lations in conflict with this regula
tion are hereby repealed, and this
regulation shall be in full force an
effect immediately upon its adop
tion and its publication as provided
by law*.
Section 6. Unconstitutionality
Clause
Should any section, paragraph,
sentence, clause, or phrase of this
regulation be declared unconstitu
tional or invalid for any reason,
the remainder of said regulation
shall not be affected thereby.

of the Clayton County Board of
Health on September 2, 1954.
