That they desire for themselves, their

incorporated for a period of thirty-five

SEPTEMBER 6. 1955.
Call to Order—The meeting was called to
order by Mayor J. K. Currie, with the
following Councilmen present: L. R. Beck
with, E. L. Foster and H. E. Waldrop.
Minutes Read -Minutes of the meetings
of August 1,5, 22, and 29 were read end
approved as read.
Sewer Easements —Motion was made by
L. R. Beckwith, seconded, and carried
unanimously, that in obtaining easements
for the sewerage system on the north side
of the City, the Mayor be granted the
authority to offer and pay up to 35c per
lineal foot for the right-of-way needed for
the sewer lines.
Rezoning— A petition by residents in the
vicinity of West Street, Georgia Avenue
and Central Avenue intersections was read
protesting the rezoning of the Central of
Georgia Railway Company's property on
West Street. The Clerk was instructed to
hold the petition on file until a full Council
is present at a meeting, and notify the
petitioners when the meeting will take
place.
Restrictions on Building—Upon motion of
E. L. Foster, seconded, and carried un
animously, the restrictions on his prop
erty imposed by Manse Waldrop were ord
ered made a part of the minutes, and are
as quoted below:
“GEORGIA, CLAYTON COUNTY
“WHEREAS Manse Waldrop has certain
lands located in Clayton County, Georgia,
principally those lands located north of
Catherine Street and West of Waldrop
Drive, which the said Manse Waldrop de
sires to improve and make available to
the public, it is necessary in order to
protect the purchasers of said property the
following restrictions are hereby set up
and shall apply to all sales of land by
Manse Waldrop when said restrictions aie
specifically referred to in deeds from
Manse Waldrop to purchasers:
“BUILDING RESTRICTIONS—
'“The land herein is sold and conveyed
subject to the following restrictions, numb
ered one to nine, which shall be binding
upon the said purchasers, and all persons
claiming or holding by, under or through
him, for a period extending to January
1, 1975, at which time said restrictions
shall be automatically extended for suc
cessive periods of 10 years unless by vote
of a majority of the then owners of the
building sites covered by these restrictions
it Is agreed to change said restrictions in
whole or in part:
"1. The property herein conveyed shall
not be used otherwise than for residential
purposes. Said property shall not be used
for a sanitarium, hospital, or infirmary,
and no apartment or boarding house shall
be erected or maintained thereon.
“2. No residence shall be erected on said
property having less than 1000 square feet
of floor area, exclusive of porches and
stoops, nor have less than five rooms and
one bath room.
'“3. No residential building shall be lo
cated on any building site less than 75
feet from the northern side of Catherine
Street, nor less than 15 feet from a side
lot line.
“4. Residential lots shall not be leased
or subdivided and sold, and not more
than one residence shall be erected thereon.
"5. No noxious or offensive trade or
activity shall be carried on upon any build
ing site nor shall anything be done there
on which may be or become an annoy
ance or nuisance to the neighborhood.
“6. No trailer, basement,, tent, shack,
garage, barn, or other outbuilding other
than guest houses and servants' quarters

campaign to bring in new indus
tries, the state at the same time
steadily is putting forth its best
efforts to promote improved ag
ricultural conditions and in
come. Gov. Marvin Griffin de
clared in a speech delivered on
“Governor’s Day” at the Georgia
State Fair, staged in Macon.
“Agriculture has been the
backbone of Georgia’s economy
for many years and our recent
progress in this field has brought
direct benefit to the entire agri
cultural industry,” he said. “This
is notably true in our gains made
in poultry and livestock produc
tion.”
The Governor, who jvas intro
duced at the Exchange Club Day
luncheon by Bibb County Rep.
Denmark Groover, Jr., of Macon,
House floor leader, cited recent
U.S. Department of Commerce
figures showing that poultry pro
duction has supplanted cotton as
the state’s largest revenue pro
ducer. Said Griffin:
“King Cotton has finally been
erected on a building site covered bv
these restrictions shall at any time be
used for human habitation temporarily or
permanently, nor shall any structure of a
temnorarv character be used for human
habitation.
"7. Invalidation of any one of these re
strictions or any part thereof by judg
ments or court order shall in no wise as
, t any of the other provisions which
shall remain in full force and effect.
“8. The failure to enforce promptly
these restrictions and conditions shall at
no time bar their enforcement, but in
spite of hnv and all delays, the said Manse
Waldrop, his successors or assigns, -nay
at any time, enforce each and all of these
restrictions and provisions.
“9. Said oroperty is sold with the fore
going restrictions, which are conditions of
the sale, affixed to and running with the
land and for a violation of the terms
.thereof, or any of them bv the purchaser,
or any person holding or claiming by.
under, or through the purchaser, the right
is expressly reserved to the seller, Manse
W aldrop. his heirs, administrators, execu
tors, and assigns, or the owner of anv lot
in his Catherine Street subdivision, to
proceed by law. or in equity, to compel a

Southeastern Fair Signs — Motion was
made by L. R. Beckwith, seconded, and
carried unanimously, that the Southeastern
Fair be permitted to put advertising signs
on utility poles in the city advertising the
1955 fair, provided they remove all signs
and clean up any remaining portions of
such signs after the fair has ended.
Erection Os A Scout Hut in Park—A re
quest from Scout Troop 169 was read ask
ing for permission to construct a Scout
hut in the park area behind the Cltv Hall.
The request was referred bv the Mayor to
the Parks Committee to find a suitable
location.
Sidewalk Petition Hendrix Dr.—A petit
ion asking that sidewalk be laid on Hend
rix Drive was read, and motion was made
by E. L. Foster, seconded, and unanimous
ly carried, that an ordinance be drawn up
calling for construction of sidewalks (on
the petition - assessment basis) on all
streets which have been filed to date ex
cept College Street.
Rezoning Denied—The rezoning request of
Mrs. Marjorie Kingston was read, request
ing; that her property on Ernest Drive be
rezoned for parking of house trailers, a
petition objecting to the rezoning was also
read and ordered filed. Motion was made
by L. R. Beckwith, seconded, and unani
mously carried, that because of objections
having been filed, the rezoning be denied.
Rezoning granted—Application for rezon
ing of the property of Joe D. Chafin, on
Barksdale Drive, for operation of a day
nursery was read, and since no objections
had been filed, motion was made by E. L.
Foster, seconded, and carried unanimously,
that the rezoning be granted.
Finance Comm to Pay Bills—Motion was
made by L. R. Beckwith, seconded, and
unanimously carried, that the Finance
Committee be authorized to pay the cur
rent bills.
Pipe to be Paid for—Motion was made
by L. R. Beckwith, seconded, and unani
mously carried, that all water main which
has been purchased to date be paid for.
Water Meters—Motion was mady by L.
R. Beckwith, seconded and unanimously
carried, that the following be instructed to
