New Law for Survivors
Benefits Now In Effect
The President signed this
month the Survivor Benefits Act
revising benefits for the de
pendents of deceased service
men and veterans who died of
service-connected causes.
Veterans Administration an
nounced that it is taking im
mediate steps to put this new
law into operation even though
payments cannot begin prior to
January 1, 1957, the effective
date of the Act.
We stressed that this law does
not change death pension bene
fits to widows and children of
veterans whose deaths were not
as a result of service.
Widows, dependent parents
and guardians of orphan chil
dren receiving compensation for
the service-connected death of a
veteran are requested NOT to
contact VA for information.
Veterans Administration will
notify each person receiving
death compensation under pres
ent law concerning his rights
under the new law.
The new law is designed to:
1. Revise the death compen
sation program by providing
monthly payments to widows
partially related to military pay;
slightly increase existing uni
form payments for orphan chil
dren; and to provide a sliding
scale of benefits for dependent
parents subject to certain an
nual income limitations.
2. Extend Social Security cov
erage to those in the armed
forces on a contributory basis;

3. Revise the six months death
gratuity to range from a mini
mum of SBOO to a maximum of
$3,000. This will be administered
by the various service depart
ments.
The new law also eliminates
coverage of service personnel
under the Servicemen’s Indem
nity Act (the so-called “SIO,OOO
free insurance") and coverage
of reserve personnel under the
Federal Employees Compensa
tion Act on and after January 1,
1957.
The new law continues the
right of veterans disabled in
service to apply to VA for the
five-year policy or any of the
six permanent plans of National
Service Life Insurance within
one year from the date VA finds
their disabilities to be service
connected.
However, the special five-year
nonconvertible NSLI term poli
cies, for which those now in
service have to apply within 120
days after their discharge will
be discontinued under the new
law on and after January 1, 1957
Policies now in force or issued
before January 1, 1957 will not
be affected.
The new form of compensa
tion for widows, orphan children
and dependent parents of those
who died as a result of service
will be called dependency and
indemnity compensation, it will
be paid by VA.
Persons eligible for death com
pensation under present law are
protected in their existing rights
and will be able to elect the new
form of compensation if it is to
their advantage.
VA will send election forms
outlining the new benefits to
help them to reach a decision.
For this reason, VA asked that
no inquiries be made either by
letters or at its offices until
after the forms are received. The
forms are expected to be mailed
to widows, guardians of chil
dren and dependent parents
within the next 30 to 60 days.
New rates of dependency and
indemnity compensation will be
paid only if the person who
elects tlie new benefit surren
de r s servicemen’s indemnity
payments. National Service Life
Insurance and U. S. Government
Life Insurance payments do not
affect the right to elect benefits
under the new law.
Payments to widows under the
new law are made at the month
ly rate of sll2 plus 12 percent
of the current basic military pay
of the rank held by the veteran

new form of compensation at
the following monthly rates:
One child, S7O; two children,
$100; three children, $130; and
each additional child, $25 each.
Children over 18 years of age
may be eligible to receive the
new compensation if they are
attending school or are helpless.

compensation for parents is paid
