Final Presentments of Clayion Counly
Grand Jury, February, 1964 Term
To: Honorable Harold R. Banke, Judge Superior Court,
of Clayton County.
The Grand Jury for the February, 1964 term of the Su
perior Court of Clayton County, Georgia convened Febru
ary 3. 1964 at 9:00 A.M. Acting on instructions the jury re
tired to the Grand Jury room for the purpose of selecting a
foreman and other officers. After deliberation the following
were elected: C. E. Lamb, Foreman; W. B. Casey, Assistant
Foreman; Walter R. Camp, Secretary; H. E. Kendricks, Jr.,
Assistant Secretary.
The jury returned to the courtroom and reported these
selections, after which we were charged as to our duties
and responsibilities.
This Grand Jury has met reg
ularly since that time, and has
considered and acted on all mat
ters brought before it. It has
further considered general con
ditions affecting the welfare of
this County, and has tried to
fulfill its duties and responsibili
ties to the Citizens of Clayton
County in a manner consonant
with their best interests.
Committees were appointed to
investigate and inspect the of
fices and records of the various
Justices of the Peace. No out
standing irregularities were
found, but it was noted that in
some instances work was needed
to bring dockets up to date, with
complete information as to ac
tion taken, dates, amounts re
ceived, etc.
This July acknowledges with
gratitude the help of those citi
zens who have brought to its at
tention conditions around the
various schools affecting the wel
fare and safety of school chil
dren, particularly in the vicinity
of the new Senior High School
in Jonesboro. This matter has
been studied as best we could in
the brief time at our disposal. We
have consulted with various
County officials directly con
cerned with this problem. They
are aware of conditions, and ap-

Following the recommenda
tion of the proceeding Grand
Jury, we inquired into the mat
ter of police insisting that cars
involved in accidents be towed
by a particular wrecker service.
This has reportedly been true
even when the owner protested
that he could obtain the service
at a much lower rate, or that
his car could be driven without
the need for a wrecker. After in
vestigating this alleged condi
tion the Jury concluded that:
Cases of this nature would
be rare, as such action on the
part of a police officer, result
ing in his personal gain, is en
tirely contrary to the policy es
tablished by persons responsi
ble for the operation of our
County Government.
Some reliable towing service
is necessary to the Police De
partment, since wrecked cars
must be removed from the
highway by a person other
than an officer in order to
avoid possible liability on the
part of the County for dam
age due to his removing the
car.
Concurrent with this and oth
er investigations the Grand Jury
had the opportunity to make ob
servations of the operation of
various police departments in
the County from time to time
during this term. It is our con
clusion that there is a diligent
effort being made by all law en
forcement groups to maintain a
high degree of law and order.
This Jury made a thorough in
vestigation of reported irreg
ularities in the designation of
bondsmen, and the handling of
bonds of prisoners We were un
able to find anything to warrent
criticism by this body; but we
do recommend that all persons
responsible for, or having any
connection with this function
exercise diligence in complying
with the law relating to the
bonding of prisoners.
In accordance with Georgia
Health Code Act 936, approved
March 18, 1964, Section 88-202 of
the Georgia Code requires us to
appoint three members to the
Clayton County Board of Health.
In accordance with this act we
hereby make the following ap
pointments:
Dr. E.A. Dunbar. Forest Park. 6
years from date of appointment.
Mr. Terrell Starr, Forest Park,
4 years from date of appoint
ment.
Mr. Lamar Hutcheson, River
dale, 6 years from date of ap
pointment.

tire term. We wish to further
commend Mr. Wallace for the
efficient and prompt manner in

attend the first session of the
National College of State Trial
