furnishing all labor, material, equip
ment and other things necessary for
3.899 miles of resurfacing on Mt.
Zion Road, beginning at State
Route 54 in Morrow and extending
easterly to State Route 138, ex
cepting 0.414 miles at 1-75.
This work is to be done under the
1966 specifications:

Estimated cost of this project is
$49,935.00. The state reserves the
right to reject any or all bids.
Said work shall begin within ten
(10) days after Notice to Proceed
has been issued and shall be com
pleted within the number of calen
dar days indicated. When contract
has been executed, written notice
shall be given the Contractor, at
which time, and not before, work
may be started.
Contract executed pursuant to
this Notice is binding on the State
Highway Department, as such. Said
contract will not create liability,
expressed or implied, against the
undersigned Director of the State
Highway Department, as an
Individual nor against any employee
J of the State Highway Department,
< in his or her individual capacity.
Plans and Specifications may be
Inspected at the offices of the
undersigned at Atlanta, and at the
Division Office indicated, and at
the office of the Board of County
Commissioners of the County in
which the work lies. Copies of the
plans may be obtained upon pay
ment in advance of the sum indi
, cated. Copies of the Standard
Specifications may be obtained
upon payment in advance of the
sum of $4.00, which sums will not
be refunded.
Proposals must be submitted on
regular forms, which will be
supplied by the undersigned, and
may be obtained by a payment, in
advance, of $5.00 for each proposal
issued. When the proposal is sub
mitted, it must be accompanied by
a proposal guaranty In the form of
a certified check, cashier’s check,
negotiable United States Bonds, or
other acceptable security in the
amount indicated, and must be
plainly marked "Proposal for Road
Construction,” County and Num
ber, and show the time of opening
as advertised. Check of the low
bidder will he cashed and all other
checks will be returned as soon as
• the contract is awarded, unless it is
, deemed advisable by the State
, Highway Department to hold one
or more checks. If an unusual con
dition arises, the State Highway De
partment reserves the right to cash
all checks. Bidders Bond will not be
accepted. Bond will be required of
the successful bidder as required by
law.
Contracts will not be awarded to
contractors who have not been
placed on the list of qualified Con
tractors prior to the date of award.
No proposal will be issued to any
bidder later than 9 a.m. of the date
of opening bids.
All bids must show totals for each
item and total amount of bid. Right
is reserved In the undersigned to
delay the award of the contract for
a period not to exceed thirty (30)
days from the date of opening bids,
during which period bids shall re
main open and not subject to
withdrawal. Right is also reserved in
the undersigned to reject any and
all bids and to waive all formalities.
Upon compliance with the re
quirements of the Standard Specifi
cations, payment for work done
shall be made in accordance with
the provisions of the Standard
Specifications.
On projects involving Federal
Funds the minimum wages to be
paid shall be the amounts set out in
the Labor Provisions included in
the Proposal. The attention of bid
ders is directed to the Special Pro
visions covering employment of
labor, methods of construction, and
subletting or assigning the contract.
On such projects, the State High
way Department, in accordance
with the provision of Title VI of
the Civil Rights Act of 1964 (78
Stat. 252) and the Regulations of
the Department of Commerce (15
C.F.R., Part 8), issued pursuant to
such Act, hereby notifies all bidders
that it will 'firmatively insure that
the contract entered into pursuant
to this advertisement will be
awarded to the lowest responsible
bidder without discrimination on
the ground of race, color, or
national origin.
In contracts involving State funds
only, House of Representatives
Resolution No. 34, requiring use of
domestic materials, will be in
corporated.

The principal of and interest on

UNDER POWER

CLAYTON COUNTY
On the 29th day of January,
1968, Johnnie J. Story executed a
note for $1,991.00 payable to
Robert I. English, which note was
payable on or before January 15,
1976. as a final payment date. Each
payment being applied to the
interest then due and the balance to
the reduction of the principal
amount, interest being computed
on the unpaid principal. Time was
made the essence of the contract.
In order to secure the payment of
said note, Johnnie J. Story exe
cuted and delivered to Robert I.
English a deed to secure a debt, I
conveying the following described I
land:
"All that tract or parcel of land
lying and being in Land Lot 114 of
the 13th District of Clayton Coun
ty, Georgia and being Lot 7, Block
I, Unit 4 Section 1, of Holiday Hills
Subdivision as per plat recorded in
Plat Book 6, page 109, Clayton
County Records.”
Said deed is recorded in Deed
Book 494, Folio 92 94, Clerk’s
Office, Superior Court, Clayton
County, Georgia.
Because the said Johnnie J. Story
defaulted in making payment of the
monthly installments as they
matured, the grantee pursuant to
the provisions of said note and the
deed aforesaid securing the same
has exercised its option and de- j
elated the entire balance due and I
collectible.
The said deed contains a power of I
sate, authorizing the grantee, as at
torney in fact for grantor therein to
sell the property conveyed thereby
in order to satisfy said note, after
advertising the same once a week
for four weeks in the official Coun
ty paper of said County, and in
accordance with said power of sale
and by virtue there of the attorney
in fact will sell the property above
described at public outcry to the
highest and best bidder for cash, on
the first Tuesday in July, 1969, at
the place of public sales before the
courthouse door in Clayton Coun
ty, Georgia, and within the legal
