I T appearing to the Court by the petition of Rich
ard F. Lyon, Adm'r, accompanied by the note
and Mortgage Deed, that on the 6th day of March,
I860, Defendant made aud delivered to him his pro*
tnisory note, henriug date the day and year afore
said, whereby the Defendant promised twelve months
after datc'ol saiJ note to pay the Plaintiff, or hearer
thirteen hundred dollars for valuo received, with
interest from date. And that afterwards, to*wit.,
on the day and year aforesaid said Defendant, bet
ter to secure the payment of said noto, executed
aud delivered to the Plaintiff his Deed of Mortgage,
convoying to Plaintiff iot of land number (78) sev
enty-eight, in tho seventh district of said county,
to be void on payment of said note. And it furth
er appearing that said note remains unpaid, it is
therefore ordered that said Defendant do pay into
t his Court, ou >>r before tho first day of the next
term thereof, tho principal. Interests and costa due
unsaid noto, or show cause to the contrary, if any
he has. And that on failure so to do, the Equity
of Redemption iu and to said mortgaged premises,
be forover barred snd foreclosed. It U further or

iVtn unco a month for three months previous to the
next term of this Court, or served on the Defendant
or his special agent or attorney, at least three
