New Orleans, Nov. 18.—Special orders No; 108, from headquarters, Oth Military District, removes Harry T. Hayes, for same reason assigned in former order removing him, snd appoints Dr. Geo. W. Avery in his place. Tho samo order removes R. P. O’Rooke, Clerk of tho 2d District Court, Parish of Orleans, for mslpractled in oflice, and appoints R. I.. Shelly to the vacancy. Shelly was former corrcspondsnt of tbe New York Tribune, now of Forney’a paper. The Times and Crescent animad vert severely on the new appointees the former, speaking ot Shelly, says, “Than whom no man in tho community i* more universally despised.” The Crescent is 1 equally severe upon him, bnt all papers, ex cept tiie Times, speak favorably of Dr. Avery. The Republlom publishes eulogis tic higoraphical sketches of both appointees. Gen. Mower left lor the North last night. The names- were ascertained lrom some juror who could take that or nny other oath, and on the sitting ol tho Court next morning Brown appeared, made affidavit thattheju ry wa. not a legal jury; that fourteen ,1 them were prrjudieed; and that Blodgett could not get justice at their hand.. L pon title affidavit, he moved to be » llowed *" challenge the fourteen for cause. Aftet argument tho motion wae sustained by Judge Eskine. Twelve of the fourteen. on being informed that they would have to take the iron clad oath, left the jury. This proceeding, uf course, veivated the finding, and Blodgett atood unaccused. At thle stage of tho game, two other jurors, who had voted against the finding, announced ihst they could not tsko tho oath. The Court imformed them that they had not been challenged, and were competent to ait in the case.
