tor of favor, granted by the Court for good
reasons; the oilier was depriving a mail o!
his rights, for if it wns aright and privilege
possessed by every citizen to be trieil’by n
jury of bis peers, it was equally his right
nnd privilege to sit on a jury.
Judge Krskinc stated that if lie had made
nn error it wns his earnest desire to correct
it at tiie earliest possible moment. He said
that tlio right to sit on a jury was not a
franchise, and in having had the oath read
before 1 he jury he did it not to require thorn
to take, hut that they might he thoroughly
informed of its nature. The Judge also
said that lie wns satisfied in his own ntiud
that several ol the jurors challenged could
not cnnsuientously take l he oath, nnd he t
therefore deemed further evidence on tiiat
point unnecessary.
The Court then overruled the motion of
‘.’ol. Fitch, and discharged the challenged
jurors for the term. Eleven out of tlio
original eighteen were lints discharged, and
their plat es tilled Iroin among the talstneti
who Imd been summoned. Xotv that tlio

liberation.
In the course of his remarks yesterday,
Judge Erskinc alluded to the refusal of the)
former grand jury to allow counsel for
Hlodgctl to intiodurn his witnesses, and al
so to a promise alleged to have been made
in Atlanta by the District Attorney that he
would allow these witnesses to appear be
fore the grand jury, lie said that counsel
had no right to insist upon the introduction
ot bin witnesses, and even if tlio District
Attorney had made such a promise (whioh
was not proven) the government could not
be bound by it. The grand jury sits to eic-
