The suit which has been beguii
4or the annulment of the lease of
the East Tennessee* Virginia and
Georgia railroad to the Richmond
•and Danville railroad promises to
be ah interesting one. * It is ex
pected that it will be heard this
month, though a decision may not
be heard for many months.
It is claimed that the East Ten
nessee, Virginia and Georgia, hold
ing as it does charters from both
Georgia and Tennessee, is con
trolled to a certain extent by the
laws -of both states. The Georgia
law provides that when any cora-
jjet’ne line acquires control of any
load chartered by the state of
Georgia, the charter of the latter
ifoad becomes void, and it is the
duty of the Attorney General of
the state to begin suit for its for
feiture. The Georgia Central is
hnw a part of the system which
controls the East Tennessee, Vir
ginia and Georgia, and is a
petitor of that line.
The Tennessee law prohibits
the purchase or lease of railways
by competing lines. It also pro
vides that aDy such lease must be
authorized by a majority of the
stockholders of the leased line. It
is asserted that there has been no
such authorization by the stock
holders of the East Tennessee,
Virginia and Georgia.
What the defense wifi be is of
Course not known, and will not be
until the answer to the plaintiff’s
petition is tiled. It is reported,
however, that the Richmond Ter
minal management is confident
that the lease of the East Tennes
see, Virginia and Georgia to the
Richmond and Danville will be
held to be valid. One of the sto
ries current is that the lawyer who
drew the ebartor of the Richmond
Terminal was told to make it so
that almost anything could be done
Under it, and. it is also said that
some of the ablest railroad lawyers
in the country have expressed the
opinion that the lease of the East
Tennessee, Virginia and Georgia
to the Richmond and Danville is
drawn with such skill that no court
in the country will declare it in
valid.
Those who are interested in the
recent big railroad deals iu tire
'south, either directly or indirectly,
will watch the progress of this
suit with deep interest.
