LEGAL SALE OF LAND
GEORGIA, HOUSTON COUNTY.
Will be sold by the undersigned at
auction at the court house door in
Houston County, Georgia, on Tuesday,
December 6, 1932, between the hours
of 10 A M. and 4 P M. to the highest
bidder for cash, the following de
scribed property:
All that tract of land in the Fifth
District of Houston County. Georgia,
containing One Hundred (100) acres
und consisting of Fifty <50i acres in
the shape of a rectangle on the South
side of lot No. Thirty-Seven (37) and
also Fifty acres in the shape of a rec
tangle on the North side of lot No.
Thirty-Eight (36) and being the same-
tract of land conveyed by J. B. O'Neal
to John W. George on October 26,
1917, as shown by deed recorded in
Deed Book 23, Page 397 in the Office
of the Clerk of the Superior Court of
Houston County, Georgia.
The above property is now a part of
Peach County, said county having
teen organized since the date of loan
deed hereafter referred to.
Said property is being sold under
the power contained in a trust deed to
secure debt from John W. George to
George K. Johnson and John W. Ha
mer. Trustees for the Penn Mutual
Life Insurance Company, said deed
being dated October 1, 1920, and re
corded in the Office of the Clerk of
the Superior Court of Houston Coun
ty, Georgia, in Book 31, Page 55, and
following, said deed securing a note
of $2,000.00 of even date therewith
end payable $200.00 on October first
annually for four years and $1,200.00
on October 1, 1925. Interest payable
annually on the 1st day of October at
the rate of 7 '/ c to maturity date,
8% after maturity date.
It is provided in said deed of trust
that in case the debt secured thereby
should not be paid in full when it be
comes due by maturity in due course
or by default, that the said Trustees,
or their successors for the purpose of
collecting said indebtedness may sell
the said property at auction at the
court house door in Houston County,
Georgia, to the highest bidder for
cash, first giving four calendar weeks
notice of the time, terms and place of j
sale by advertising once a week in a
daily newspaper published in said
County and State. On February 4th,
1926, the above mentioned indebted
ness was extended to mature as fol
lows: $200.00 on October 1st, 1926,
1927, 1928 and 1929 respectively; and
$1,200.00 on October 1st, 1930, inter
est 6' ,' , payable annually on Oct. 1st,
extension being between John W.
George and William A. Law and L. i
W. Stccblc and recorded in Clerk’s
Ottice, Houston Superior Court in
Bodk B, page 421. There having been*
default in the payment of the balance ,
of interest due October 1, 1929, inter
est due October 1, 1930, 1931 and
1932 and in the payment of $2,000.00
the principal due October 1st, 1932 by
e xtension the power of sale has be
come operative and the Penn Mutual
Life Insurance Company, holder of
.- aid note, has requested the said Wil
liam A. Law, Surviving Trustee, said
L. W. Stecble being deceased, to en
force the collection of the said in
debtedness as provided for by the
terms of the deed above referred to.
The amount of said debt now due
and collectible is $2,000.00 principal
having matured October 1, 1932, by
extension and $419.70, total interest
due besides interest from maturity
dates on both principal and interest at
8' , to date of settlement.
The proceeds of said sale to be ap
plied to the indebtedness above de
scribed and to the cost of these pro
ceedings and the balance, if any, to
he paid to John W. George or his as
signs. Fee simple deed to the purchas
er will be made in accordance with
the powers in the trust deed referred
to.

On June 28, 1924, Herbert Vining,
the grantee in the deed to secure debt,
sold and transferred to Isaac Miller,
his heirs and assigns, the note for the j
principal sum of $4116.00 and con
veyed to the said Isaac Miller, his
heirs and assigns, an interest in the
deed to secure debt and in the prop
erty therein described, the interest
conveyed being ratably and in pro
portion as $4116.00 is to $6000.00. The
said transfer is duly recorded in the
office of the Clerk of Houston Supe
rior Court on April 22, 1925.
