one body, lying and being about two
miles East of the City of Perry, Geor
gia, on the Perry to Tivola public
toad, in the 13th Land District of
Houston County, Georgia, consisting

in said district, to-wit: 189.42 acres,
more or less, being the whole of land

following, said deed securing a note whole of land Lot No. 150; also, 202.5
of $2,000.00 of even date therewith
and payable $200.00 on October first
annually for four years anu $1,200.00
on October 1, 1925. Interest payable
annually on the 1st day of October at
the rate of 7'/ ( , to maturity date,
8% after maturity date.
It is provided in said deed of trust
that in case the debt secured thereby
should not be paid in full when it be
comes due by maturity in due course
or by default, that the said Trustees,
or their successors for the purpose of
collecting said indebtedness may sell
the said property at auction at the
court house door in Houston County,
Georgia, to the highest bidder for
cash, first giving four calendar weeks
notice of the time, terms and place of
sale by advertising once a week in a
daily newspaper published In said
County and State. On February 4th,
1926, the above mentioned indebted
ness was extended to mature as fol
lows; $200.00 on October 1st, 1926,
1927, 1928 and 1929 respectively; and
$1,200.00 on October 1st, 1930, inter
est 6%, payable annually on Oct. 1st,
extension being between John W.
George and William A. Law and L.
W. Steeble and recorded In Clerk’s
Office, Houston Superior Court in
Book B, page 421. There having been
default in the payment of the balance
of interest due October 1, 1929, inter
est due October 1, 1930, 1931 and

above described aggregating 633
acres, more or less, in said 9th Dis
trict of Houston County, Georgia, and
being the same lands conveyed by the
said Herbert Vining to W. P. Carr by
deed of this date.
At the time of the execution of said
deed to secure debt the property was
located in Houston County, but since
the execution of the deed to secure
debt Peach County has been created
and the lands are now located in the
9th District of Peach County, Georgia.
Said deed to secure debt was given
to secure the payment of two notes,

On June 28, 1924, Herbert Vining,
the grantee in the deed to secure debt,
sold and transferred to Isaac Miller,
his heirs and assigns, the note for the
principal sum of $4116.00 and con
veyed to the said Isaac Miller, his
heir3 and assigns, an interest in the
deed to secure debt and in the prop
erty therein described, the interest
conveyed being ratably and in pro
portion as $4116.00 is to $6000.00. The
