Bank hereinafter, for convenience,
called the “Condemnee.”
The Georgia Power Company,
hereinafter for convenience called
the “Petitioner,” for the purpose
of condemnation as hereinafter
set out, hereby notifies you as fol
lows:
1. That it is a corporation char
tered and organized under the
laws of the State of Georgia, for
the purpose of owning and con
trolling water powers, erecting
dams, constructing steam plants
generating electricity by water
and steam power, erecting and
operating transmission and distri
buting lines, transmitting and dis
tributing electricity to be sold
and used for lighting towns and
cities, for supplying motive power
to railroads, street car lines and
industries, for supplying light,
heat and power to the public gen
erally, both urban and rural with
the right to exercise eminent do
main for the aforesaid purposes.
2. Your Petitioner shows that it
owns and controls water powers,
steam plants, transmission and dis-j
tributing lines in this State, and is
operating said plants and works,
generating electricity by water and
steam plants, used for lighting ci
ties and towns, supplying motive
power to railroads, street car lines
and industries, supplying light,
heat and power to the public gen
erally; that it owns, operates and
maintains a system of electric
transmission and distribution
lines, both urban and rural, with
wires, fixtures and appliances, in
cluding overhead and underground
protective wires, is transmitting,
distributing and is proposing to
transmit and distribute electricity,
with wires, fixtures and appliances
erected on wooden poles, wooden
frames, steel poles, steel frames or
steel towers.
3. This notice is given to you
as owning, controlling and being
in possession of, or having any
interest in the following lands in
Houston County, Georgia:
That tract or parcel of land,
situate, lying and being in the
Upper sth District of Houston
County, Georgia, consisting of
76,26 acres of Land Lot No. 118
and 101 83 acres of Land Lot No.
143; also 93.7 acres of Land Lot j
No. 160 in the 10th District of j
Houston County, Georgia, and
50.49 acres in Land Lot No. 161 in
said 10th District. Said tracts of
land lying in a body and contain
ing 321 acres, more or less, and
known as the Josiah Bass Place.
A plat of said land is recorded in
Map Book 1, Page 206, Clerk’s
Office, Houston Superior Court
and referred to for all purposes.
4. Your Petitioner shows that
in order to transmit electric pow
er and current from said water
powers and steam plants, to be
used for the purposes aforesaid it
is necessary to obtain an easement
for a right-of-way across said J and
belonging to said Condemnee for j
the purpose of erecting transmis
sion line or lines, with towers,

point of beginning; thence from
said point of beginning continu

distance of sixty-five and two
tenths (65.2) feet; thence North
74 degrees 53 minutes West a dis
tance of three hundred (300) feet
to the center of a field road and
lands of Mrs. J. T. Ryals; thence
in a northeasterly direction along
center of field road and lands of
Mrs. J. T. Ryals a distance of two
hundred eight (208) feet to the

of beginning as shown outlined in
red on plat marked Exhibit “B” ,
attached hereto and made a part
hereof.
5, Your Petitioner shows that it
has been unable by contract or ne
gotiations to procure from said
Condemnee the easement for said
right-of-way across said lands and
cannot agree with said Condemnee
upon the compensation to be paid -
for said casement for said right
of-way.
6. Therefore, you Petitioner,
Georgia Power Company, in ac
cordance with the provisions of
its Charter and the laws of the
State of Georgia, in such cases
made and provided, acting under
proper corporate authority duly
granted by its Board of Directors,
desires and proposes to acquire by
j condemnation proceedings an ease
ment for said right-of-way as here
in described across the property
of Condemnee, by paying for the
same in accordance with the laws
of the State of Georgia, as made
and provided in such cases and to
procure an easement for said right
of-way in order to occupy said
right-of-way as aforesaid, in order
to construct, operate and maintain
your Petitioner’s transmission and
distributing lines and to protect
said lines and keep said right-of
way and lines clear of trees and
other obstructions, objects and
structures.
7. The amount of interest sought
to be condemned being an ease
ment for a right-of-way as herein
before described across said pro
perty, with the continuous right
from time to time to go in and
upon said right-of-way and to con
struct, erect, install, operate, main
tain, inspect, reconstruct, repair,
rebuild, renew and replace there
on towers, frames, and poles, with
the right to attach to said towers, I
frames and poles necessary wires,
fixtures and appliances, including
communication lines and overhead
and underground protective wires,
for the proper transmission of
electricity; also the right to substi
tute frames for towers or poles, or
towers for frames or poles, with
the right to brace the towers,
frames and poles with such an
chors, guy wires and support as
may be necessary to hold said tow
ers, frames and poles firmly in
position; also the right to clear,
keep clear and to remove from
said right-of-way all undergrowth,
trees and other obstructions, ob
jects and structures, and to cut
away and remove such trees ad
jacent to said right-of-way that
may interfere with, injure or en
danger said line or lines or the
proper operation and maintenance
thereof; also the right of ingress
and egress, at any and all times, to
and from said right-of-way, by the
nearest and most practical route,
using existing roads as far as
possible, for the purpose of con
structing, erecting, installing, op
erating, maintaining, inspecting,
reconstructing, repairing, renew
ing, replacing and rebuilding said
line or lines. All of the land actu
ally taken will be that occupied by
said wires, guy wires, anchors, bra
ces, supports, towers, frames and
poles; the land between the tow
ers, frames and poles may be used
by the owners of said land, or their
assigns, for agricultural or simi
lar purposes, provided such use
is not inconsistent with the rights
sought to be condemned and fur
ther that such use does not inter
fere with, injure or endanger said
towers, frames, poles, wires, lines,
and the construction, erection, in
stallation, operation, maintenance,
inspection, reconstruction, repair
ing, renewal, replacement and the
rebuilding thereof and the uses
for the purposes hereinbefore sta
ted.
8. NOW, THEREFORE, The said
Condemnee is hereby notified that
Petitioner will proceed by condem
nation proceedings according to
law, to acquire said easement for
right-of-way across said property
and that the assessors will meet
on the premises on the 28th day
of September, 1961, at 2:00 o’clock,

notifies Condemnee to select his,
her or their assessor and that the
assessors for the Petitioner and
Condemnee select a third assessor
in accordance with the laws of the
State of Georgia.
9, The Condemnee is hereby no
tified that in the event said Con
demnee does not select an assessor
as provided for by law, to act for
said Condemnee, Petitioner will
forthwith nad without further no
tice, petition the Ordinary, pursu
ant to Section 36-401 of Code of
Georgia, 1933, for the selection of
an assessor to act for said Condem
nee; that in the event the two as
sessors do not, within five (5) days
after their selection and/or ap
pointment, agree on a third asses
sor, Petitioner will pursuant to Sec
tion 36-402 of Code of Georgia, pe
tition a Judge of a Superior Court
of the State of Georgia, for the
appointment of a third assessor.
Petitioner stands ready to pay
such assessment as may be deter
mined by said assessors, according
to law.

on September 25, the temperature
was nearly 100 degrees and there
was no relief in sight . . . and it’s
getting dry and it’s time to plant
those winter cover and grazing
crops . . . it’s fine weather for i
cotton picking, peanut harvesting
and hay making however ....
which just goes to show that every
cloud has that silver lining . . .

for the power auger to finish the

The Perry FFA held its annual
eliminations in the chapter sweet
heart contest Tuesday night, Sep
tember 26. The executive commit
tee composed of all the officers of
the chapter interviewed each of
