ORDINANCE
BE IT RESOLVED BY THE
MAYOR AND COUNCIL OF THE
CITY OF PERRY:
Section One: That the following
named streets shall be paved: (1)
Grant Street, (2) Horton Street,
(3) Pierce Street, (4) Oldfield
Lane (from Lucille Avenue to
Horton Street;
Section Two; That the cost of
said paving shall be as follows;
The property adjoining said
streets shall be assessed on a one
third basis with the City of Perry
paying one third of the costs, and
one third of the costs assessed
against each property owner
abutting on either side of said
streets. Said assessments, as an
option of the property owner, shall
be payable over a term of five (5)
years, the first payment due on or
before the 31st day of March, 1976,
and annually thereafter, said
amounts bearing interest at the
rate of six (6 percent) percent per
annum Provided further that in
the event of failure to pay an
installment in any tax year, the
remaining balances due shall
become due and payable in full
and fi fas shall issue as in the case
of unpaid taxes.
Section Three; Provided,
further, under the power and
authority as set forth in the
Charter of the City of Perry, this
paving assessment shall be
collectible under the provisions
for, and in the case of, collections
for other taxes.
Section Four: Provided, fur
ther, under the authority as set
forth in Georgia Code Annotated,
Section 69 403, this Resolution
shall be published once a week for
three consecutive weeks in The
Houston Home Journal and if the
owners of a majority of the lineal
feet of frontage of the lands
abutting on said street shall not in
fifteen (15) days after the last
publication of this Resolution file
with the Clerk ot the City of Perry
their protest in writing ot such
improvements, the governing
authority ot the City of Perry shall
have the power to cause said
improvements to be made, and to
contract therefor, and so make
assessments and fix liens as
provided for herein.
Section Five: The effective date
of this Resolution is the 7fh day of
October, 1975.
