Whereas, on the 7th day of
September, 1976, Vanguard
Land Acquisition Company, 1
Inc. (“Debtor") did execute 1
and deliver to The Fulton
National Bank of Atlanta
("Lender") a certain deed to
secure debt (the "Deed to
Secure Debt") conveying the
real estate (the "Property")
described in Exhibit "A"
attached hereto and in
corporated herein by 1
reference;
EXHIBIT "A"
An undivided eighty-seven
and eight-tenths per cent (87.8
percent) Interest In and to the
following:
All that tract or parcel of
land lying and being In Land
Lot 318 and 319 of the Thir
teenth Land District, Houston
County, Georgia, being 121.59
acres as shown on plat of
survey of the property
belonging to Tom Chapman by
Milton Beckham, Surveyor,
dated January 6, 1961 and
subsequently revised July 7,
1971, and a copy of which Is
recorded in Map Book 14, page
239 In the Clerk's Office,
Houston Superior Court. Said
plat and recorded copy thereof
are Incorporated herein by
reference for all purposes.
The property herein
described Is bounded on the
northwest by the right-of-way
of U.S. Highway No. 41 and the
property now or formerly
owned by Julian Cawthon; Is
bounded on the north by the
rlght-of way of a county road;
is bounded on the east by the
easterly land lot line of said
Land Lot 319 and the westerly
right-of-way of Interstate 1-75;
is bounded on the sooth by the
southerly land lot line of said
Land Lot 319; and is bounded
on the southwest by Tract "B"
as shown on said plat.
WHEREAS, the Deed to
Secure Debt was recorded In
Deed Book 486, beginning at
Page 495, In the Office of the
Clerk of the Superior Court of
Houston County, Georgia;
WHEREAS, the Deed to
Secure Debt was given to
secure an indebtedness In the
original principal amount of
Two Hundred Forty-Nine
Thousand Eight Hundred
Seventy-Five and 62 100
Dollars ($249,875.62)
evidenced by a promissory
note (the "Note") dated
January 25, 1975, made by
Vanguard Properties, Inc. In
favor of Lender, bearing In
terest and default Interest and
payable on the terms and
conditions specified therein;
NOW, THEREFORE, ac
cording to the terms of the
Deed to Secure Debt and the
laws In such cases made and
provided, the undersigned will
expose the Property tor sale to
the highest bidder for cash on
the first Tueiday In Novem
ber, 1977, between the legal
hours for sale, before the
courthouse door In Houston
County, Georgia, such sale to
continue from day to day
thereafter until the Property Is
sold.
The Property will be sold as
the property of Debtor, which
may be the party in possession
of the Property, and subiect
to: (I) all unpaid taxes and
assessments against the
Property, If any; (II) all prior
easements, limitations,
restrictions, judgments, liens
and other matters affecting
the Property of record, If any;
and (III) alt matters which
would be disclosed by a
current survey and Inspection
of the Property, If any.
The indebtedness evidenced
by the Note and secured by the
Deed to Secure Debt has been
and Is hereby declared due and
immediately payable because
of a default In the payment of
the principal and interest due
under the Note. The proceeds
from the sale will be applied
first to the payment of all
indebtedness secured by the
Deed to Secure Debt, to all
taxes, assessments, and
premiums of insurance which
may have been paid by the
undersigned on behalf of
Debtor and to all expenses of
the sale, with the remainder, If
any, to Debtor.

terms of said deed and the note

to the power of sale contained
in said deed, there will be sold

outcry before the courthouse
door of Houston County,
Georgia, on the Ist Tuesday in
November, 1977, the same
being November Ist, 1977,
within the legal hours of sale,

correct amount must be made
within 30 days of billing; such
payments are not refundable.
Notices to Contractors which
include items and quantities
are available upon payment of
$12.00 annually.
Proposals must be sub
mitted on the proposal form
issued by the Department.
Each proposal submitted must
be accompanied by a proposal
guaranty in the indicated
amount in the form of a Cer
tified Check, Cashier's Check
or Bid Bond on the form issued
by the Department or the
Georgia Highway Authority.
In accordance with the
Standard Specifications, the
time set for receiving bid
proposals terminates at 11:00
a.m. at Room 234 in the State
Highway Building. The bid
proposals will then be tran
sferred to Room 401 where
they will be publicly opened.
Bid proposals will not be
received after 11:00 a.m. Bid
proposals may be withdrawn
by the bidder from Room 234
prior to 11:00 a.m. but cannot
be withdrawn after 11:00 a.m.
A withdrawn bid proposal
may again be received in
Room 234 prior to 11:00 a.m.
Acceptance of an offer
submitted by the bid proposals
will be given in writing within
thirty days after the opening of
the bid unless a longer period
is specified in the proposal or
agreed upon by the successful
bidder. Offers of bidders who
do not hold a current Cer
tificate of Qualification, will
not be accepted unless
prequalification requirements
are specifically waived for the
project.
Work will be governed by the
applicable edition of the DOT
Standard Specifications
as amended by the contract
provisions. Contract time will
be as indicated. Payment will
be made to the contractor each
calendar month based on the
estimated work complete in
place as prescribed by
Standard Specifications.
Retainage as prescribed by the
Standard Specifications will be
withheld. Retainage may be
deposited in escrow accounts
at the option of the Contractor.
Final payment of amounts
withheld or deposited in
escrow will not be made until
the State Highway Engineer
has certified that the work has
been satisfactorily completed
and accepted.
Projects financed with
Federal funds will contain
provisions with regard to equal
employment opportunities,
minimum wages, employment
of labor, methods of con
struction, minority business
enterprise involvement, and
subletting or assigning the
contract. On such projects
Department will insure thaf
minority business enterprise
contractors will be afforded
full opportunity to submit bids
in response to this invitation
and will not be discriminated
against on the grounds of race,
color, or national origin in con
sideration for an award. On
such projects all bidders must
certify and document that
potential minority business
enterprise subcontractors
have been contacted and that
their interest, capabilities, and
prices have been affirmatively
solicited.
Any federally financed work
located within the counties of
Fulton, DeKalb, Cobb, Clayton
and Gwinnett, the estimated
cost of which exceed
$500,000.00 will be subject to
the requirements of the
Atlanta Plan.

cluded in the contract special
provisions where applicable.
Copies of the Atlanta Plan are
available from the same
source as plans and proposals.
This advertisement is
merely an invitation for the
submission of bids which are to
be considered as offers for
performance of work by the
submitting party. The state
reserves the right to reject any
or all bids.
The Department reserves
the right to release Bidders
Lists on any projects it may
select or on all projects. Such
Bidders Lists will contain the
names of all contractors who
have been issued bid proposals
valid for bidding.
