Because of default in the payment of
an indebtedness of Gene R.
Cunningham to Irene E. Eaves, which
debt is secured by a Deed to Secure
Debt executed by Gene R. Cunningham
to Irene E. Eaves dated August 1,1984,
and recorded in Deed Book 662, Pages
402-404, Clerk's Office, Houston
Superior Court, the undersigned Irene E.
Eaves pursuant to said deed and the
note thereby secured, has declared and
does hereby declare the entire amount
of said indebtedness due and payable,
and pursuant to the power of sale
contained in said deed, will on the first
Tuesday in October, 1991, during the
legal hours of sale, at the Courthouse
door in Houston County, Georgia, sell at
public outcry to the highest bidder for
cash the property described in said
deed, to-wit:
All that tract or parcel of land situate,
lying and being in Land Lot 201 of the
Fifth Land District of Houston County,
Georgia, and being known and
designated as Lot 9, Block "C", on a plat

sold as the property of Gene R.
Cunningham and will be sold subject to
restrictive covenants applicable to said
property, easements of record and any
taxes due.

to collect attorney's fees in accordance
with the terms of the note secured by

NOTICE OF SALE
GEORGIA, HOUSTON COUNTY:
Undersigned will sell before the
Courthouse door in Houston County,
Georgia between the legal hours of sale
on the first Tuesday in October, 1991 to
the highest bidder for cash the following:
All that tract or parcel of land situate,
lying and being in Land Lot 216 of the
fifth Land District of Houston County,
Georgia, being known and designated
as Tract "A" and Tract "D", according to
a map or plat of survey prepared by
Theodore W. Waddle,Georgia
Registered Land Surveyor No. 924,
dated October 3, 1961, entitled "Portion
of C.F. Williams' property", a copy of
which is recorded in Map Book 7, Page
84, Clerk's Office, Houston Superior
Court. Said plat and the recorded copy
thereof are hereby made a part of this
description by reference thereto for all
purposes
There is excepted and expressly
excluded from the above described
property the following tract or parcel, to
wit: All that tract or parcel of land
situate, lying and being in Land Lot 216
of the sth Land District of Houston
County, Georgia, known and designated
as Tract “A-1“, according to a map or
plat of survey prepared by Waddle and
Company, certified by Theodore W.
Waddle, Jr., Georgia Registered Land
Surveyor No. 2139, dated August 8,
1988, entitled "Property plat for John C.
Boone", a copy of which is recorded in
Map Book 35, Page 139, Clerk's Office,
Houston Superior Court. Said plat and
the recorded copy thereof are made a
part of this description by reference
thereto for all purposes.
Said sale will be conducted and a
deed executed to the purchaser
pursuant to the powers contained in a
deed to secure debt from SAMUEL J.
DeANGELO and DONALD R. MINOR to
BANK SOUTH, MACON dated August 9,
1988, and recorded in Deed Book 816,
Page 485, Clerk's Office, Houston
Superior Court. Said Deed to Secure
Debt was executed to secure a
Promissory Note between the same
parties of the same date in the amount
of $287,000.00, together with interest
from that date at the rate of 12% per
annum, principal and interest being
payable in thirty-three (33) consecutive
monthly installments of THREE
THOUSAND FOUR HUNDRED FIFTY
TWO AND 52/1 OOths ($3,452.52) each,
beginning September 15, 1988, and
continuing thereafter with a final
installment due on June 15, 1991.
Bank South, Macon, is the owner and
holder of said Note and of said Deed to
Secure Debt which secures the same.
The said SAMUEL J. DeANGELO and
DONALD R. MINOR are in default under
the terms of the note due to their failure
to make payments according to the
terms of said note when due, and in
accordance with the provision of said
note and said deed to secure debt, the
undersigned has exercised its option to
declare the remainder of the debt due
and collectable, and the power of sale
contained in said deed to secure debt
has become operative.
The said SAMUEL J. DeANGELO and
DONALD R. MINOR have been notified
in writing that the provisions in said note
relative to the payment of attorneys
fees will be enforced.
Said sale will be conducted subject to
any city, state and county ad valorem
taxes which may be due and payable on
said property, a deed executed to the
purchaser, and the proceeds applied in
accordance with the provisions of said
Deed to Secure Debt.
