Berlin tells Exchange
Club lawyers love a fight
By EMERY WARNOCK
Staff Writer
“The reason why Georgia has
more appeals cases than Florida,
Alabama and South Carolina pul
together is because we love to
fight,” Bob Berlin, attorney, teacher
and Macon judge, said to Perry Ex
change Club members Thursday.
Berlin continued by saying media
tion practices can largely be used
instead of litigation.
“Mediation can be used in hope
fully solving problems without
killing each other,” Berlin said.
“Most of us arc poor negotiators;
lawyers are the worst,” he added.
He explained the object of lawyers
often is about winning rather than
simply mediating tire two parlies as
they negotiate.

“Mediation is only one-eighth the
cost of going to court and is about
one-tenth of the time in going to
court,” he said.
“This is really the best answer for
simple transactions. Plus, it’s
something you can adjust in your
daily lives.”
Berlin explained that one has to
consider the other party’s desires in
dealing with clarifying the interests
and not the positions to generate
better and more useful options.
He said a lot of people are stub
born and this is one of the biggest
obstacles in meeting an agreement
with another person or another
party.
“Stubbornness is only fear. These
