Under and by virtue of the power of
sale in a certain Deed to Secure Debt
from Glenn D Shepard and Debra Mae
Meadows, Grantors, to Bank South,
N A , f/k/a, Bank South, Houston
County N.A , Grantee, dated the 28th
day of August, 1990 and recorded in
Deed Book 892, Page 54, Clerk's Office,
Houston County Superior Court, said
Deed to Secure Debt having been given
to secure a note dated the 28th day of
August, 1990, there will be sold by the
undersigned at public outcry, during the
legal hours of sale before the
Courthouse of Houston County, Georgia
on the first Tuesday in August, 1992, to
wit the 4th day of August, 1992 to the
highest and best bidder for cash, the
following described property:
ALL THAT TRACT OR PARCEL of land
situate, lying and being in Land Lot 104
of the Tenth District of Houston County,
Georgia and being that certain 0 95 acre
tract as shown on plat of survey made
by Rhodes Sewell, State Surveyor No
160 on June 28, 1968, a copy of said
plat of survey being of record in Plat
Book 13, Page 126, Clerk's Office,
Houston Superior Court, and said tract
of land being more particularly described
according to said plat of survey as
follows: STARTING at the northwest
corner of Land Lot 104 in the said Tenth
District and running thence North 89
degrees 40 minutes East along the north
line of said Land Lot 104 for 1,017.6 feet
to the POINT OF BEGINNING, thence
North 89 degrees 40 minutes East for
227 4 feet to a point, thence South 09
degrees 40 minutes West for 213 feet to
a point, thence North 82 degrees 06
minutes West for 192 4 feet to a point;
thence North 00 degrees 20 minutes
West for 182 5 feet to the said point of
beginning Said plat of survey and the
recorded copy thereof are hereby made
a part of this description by reference
thereto
Grantors covenant and agree that
any sale or change in possession of the
real estate herein described, or any part
thereof without the written consent of
the grantee, shall, at the election of the
grantee, constitute a default hereunder
and render the entire indebtedness
secured hereby immediately due and
payable
The debt secured by said Deed to
Secure Debt and Note has been and is
hereby declared due and payable in full
because of default pursuant to the
terms of Said Deed to Secure Debt and
note Notice has been given to enforce
provisions for collection of attorney's
fees and foreclosure in accordance with
the legal requirements and the terms of
the Deed to Secure Debt and Note The
indebtedness remaining in default, the
sale will be made for the purpose of
applying proceeds thereof to the
payment of the indebtedness secured
by the Deod to Secure Debt, accrued
interest and expenses of the sale and
other sums secured by the Deed to
Secure Debt, including the attorney's
fees, and the remainder, after applying
said proceeds to any other
indebtednesses owed by Grantors to
Grantee, if any, shall be applied as
provided by law.
To the best of the undersigned's
knowledge and belief, the property is in
the possession of Glenn D Shepard and
Debra Mae Meadows and said property
will be sold as the property of Glenn D
Shepard and Debra Mae Meadows Said
property will also be sold subject to all
outstanding ad valorem taxes, street
improvements, and easements or
restrictions of record, if any The
undersigned will execute a deed to the
purchaser at said sale as provided in the
Deed to Secure Debt

a Contract Documents may be

following basis:
1. General Contract Bidders: Upon
payment of a deposit of $150.00 per set
of plans and specifications, deposit of
two sets will be fully refundable to each
General Contractor who submits a
bonafide bid upon return of the
documents in good condition within
thirty (30) days after opening of bids.
Deposits for additional sets will be
refunded with deduction approximating
cost of reproduction of documents upon
return of documents, in good condition,
within thirty (30) days after opening
bids.
2 Others: Upon payment of a
deposit of $150.00 per set of plans and
specifications, deposit will be refunded

1.3 CONTRACT AWARD
a. Contract, if awarded, will be on a
lump sum basis, no bid may be
withdrawn for a period of thirty-five (35)
days after time has been called on date
of bid opening bids must be
accompanied by a bid bond or cashier's
check, made payable to Houston
County Public Library Board of
Trustees, in amount not less than 5% of
the base bid Both a Performance Bond
and Payment Bond will be required in an
amount equal to 100% of the contract
price.

a The Owner reserves the right to
reject any and all bids and to waive
technicalities and informalities and can
accept a bid notwithstanding that any
